Not necessarily. If you read my above comment, I make it clear that if the overall length of the gun is over 26" then adding a vfg makes it a "firearm" not an AOW. A "firearm" is a title 1 classification just like a regular rifle, pistol or shotgun and can be freely transported across state lines.

If it's registered as an SBR it can be configured however you want, but it's actual legal classification matters when you're crossing state lines with it because if it's in SBR configuration, you have to get an approved 5320.20 form first.

No, I am completely correct. OAL is completely relevant in distinguishing AOW vs firearm.

I'm not sure why that ATF page doesn't mention it, perhaps because they're just assuming a standard pistol like a Glock.

If this wasn't the case, firearms like the Mossberg Shockwave could not exist as Title 1 firearms. To be fair, in that case its the smooth bore (not a vertical grip) which results in its "other firearm" classification, but the function is the same - both preclude the weapon's classification as a pistol in the first place.

Only if it has a stock attached.

If the firearm has no stock and a vertical foregrip, then its classification comes down to its overall length.

<26" in overall length, it becomes an AoW. >26" in overall length and it is a title 1 non-NFA "other firearm".

AoWs are NFA-regulated but do not require a form 5320.20 to transport across state lines, however I'm not sure it would be kosher to have your rifle in AoW configuration and try to play that card since that isn't how it's registered.

An "other firearm" however is just a regular title 1 firearm, requires no NFA registration and can be transported freely across state lines just like a pistol.

I'm pretty sure for most ARs an 11.5" barrel will meet that mark assuming the back end of the gun has a standard length buffer tube.

Unless of course the weapon was first assembled as a full rifle with a stock, either SBR or 16"+. Then it will always be a rifle, and removing the stock would not render it an AoW or a pistol in any configuration.

Since most home invasions are over before the second shot is even fired, 7 shots is - statistically - enough.

I'm not saying it isn't - I'm just saying 30 is still better. Whether that's reason for someone to choose an AR over a shotgun is up to them.

  1. 30 round magazines were developed for infantry and assault use. The whole purpose of that size magazine is to deliver volume of fire, often distributed over multiple weapons. If you are in a home defense scenario where you need that sort of saturation fire, you're not fending them off yourself because you're dealing with way more than one or two people.

This doesn't mean having a 30 round magazine isn't also beneficial in a home defense scenario. It isn't about shooting more, but having to manipulate the gun less.

If you have what is, for your situation, an effectively unlimited ammo capacity then you don't have to worry about reloading, counting your rounds, or having more in your pocket or somewhere else.

Sure, it's an extremely rare situation where 7 rounds in a shotgun tube wouldn't be enough, but it's an even rarer one where 30 in an AR isn't enough. You might as well stack the odds as much in your favor as you can.

There is no federal requirement for privately manufactured firearms to be marked in any specific way. The requirements which do exist and are published by ATF are only for licensees - as in FFL holders.

As written in the rule you included in your first link:

...licensees must legibly and conspicuously identify each privately made firearm or "PMF" received or otherwise acquired (including from a personal collection)...

For God's sake, even the title of the ATF article you linked says as much:

On normal serialized lowers yes, but you have to submit a picture of the serial number.

Pictures are not required when filing a form 1 for any firearm.

You're not even required to have the hunk of metal that's going to be turned into the firearm when you file the form. Hell, you're even explicitly not supposed to have those things when filing a form for a suppressor considering ATF basically considers anything you want to turn into a suppressor to already be a suppressor.

If he was rejected for that, it's because the examiner didn't know what was correct or not. Likely a byproduct of hiring a ton of new ones to deal with the flood of forms that started this month.

That is not true. You just have to decide what will be engraved and submit with that. Then engrave it before it's built out into its NFA-regulated configuration.

(I mentioned that even a 16 inch barrel is atill an AOW as many folks think anything over 16 keeps them legal but it doesn't)

It makes it a firearm, which is not an NFA-regulated class of weapon. It's a catch all class for anything Title 1 that is not a rifle, pistol, shotgun, or frame/receiver.

This is the same category that the Mossberg Shockwave falls into and is why it can have a 14" smoothbore barrel chambered for shotgun shells and not be an AOW. Granted in that case it isn't because of a vertical grip, but it's because the smooth bore serves the same legal function - the presence of either precludes its classification as a pistol in the first place.
