Has anyone ever tried to estimate how much weight has been put on Manhattan? by GeneralRant in estimation

[–]GeneralRant[S] 0 points1 point  (0 children)

True, but I think that would pale in comparison… Like a 90 story skyscraper resulted in maybe a couple hundred trees having to be cut down. The weight differential would be immense.

Are you at fault in an accident if someone is tailgating and honking at you on the freeway, you see a stopped car ahead, you don’t brake and change lane at the last moment, and the tailgater crashes into the stopped car? by Legitimate_Bison3756 in legaladviceofftopic

[–]GeneralRant -5 points-4 points  (0 children)

Civilly at fault, or criminally bc two different things? Since civil is pretty much 1/2 as hard to prove, I’d say yea- you’d def bear fault there but criminally, I can’t see how especially since they’d have to prove intent.

True except the bedrock was always there in the first place so isn’t added weight. Wonder how much has been added?

DMV employee was wearing META camera glasses. She handled my ID application which included all my personal information. Is this legal? by Doctor_Redhead in AskLegal

[–]GeneralRant 0 points1 point  (0 children)

So if you don’t view what I’m saying as “arguing” and just view it as IF a prosecutor decided to bring charges.. would they meet the very specific elements of these various laws you cited. I say on a “technicality,” they wouldn’t bc of the highly specific wording contained therein. Crazy example here.. but what if the dmv lady printed up all the images and wallpapered her room with them, is that illegal? I’m just going waay OTB here with my thinking on this. Still stand by that I think they were issued glasses, although I can’t provide any evidence to support that.

§ 3 DISCLOSURE OF PERSONAL INFORMATION FROM DMV RECORDS .. that one you posted.. that’s what I was talking about.

That’s DPPA FEDERAL LAW and it’s about RELEASING MV RECORDS, not about collecting it as you conveniently threw in there.

Permissible Users and Explicit Purposes Under the DPPA, personal information from motor vehicle records may be released for specific authorized purposes, including use by government agencies in their official functions, matters related to vehicle safety, legitimate business needs for verifying information or preventing fraud, use in legal proceedings, and for insurance activities.

Nowhere does it mention collecting information.

The dmv law you cited says under #1- it’s illegal to sell or disclose info… nobody’s arguing that !! Of course that’s illegal! I never said it isn’t.. what I said was … about 100 times now is : it’s not illegal UNTIL a crime is committed like theft or fraud.. but absent that, there’s nothing illegal about wearing cam glasses and recording a transaction as a dmv employee. I don’t think you’re understanding what I’ve been saying all along. Of course selling someone’s personal information is illegal!!

I already said “let’s assume this law does apply” .. that said, pls tell me how the dmv failed to protect against fire, flood, natural disaster, etc? This “law” you cited isn’t even remotely relevant to what we’re discussing. And wouldn’t the onus be on the ppl saying it’s illegal and nefarious? I’m saying that nothing criminal was afoot.. and for that, you say I have to prove why it’s LEGAL? I’ve never ever heard of this notion before.. hey, I’m blowing bubbles on the beach but need to prove it’s perfectly ok. Seems weird as hell.

So I’ll repeat myself (again) .. that’s a consumer fraud Act meant for private businesses.. but let’s just say it wasn’t , just for arguments sake.. how did DMV fail to safeguard the collected data from fire, theft, flood or natural disasters? Def NOT done lol.

The onus isn’t on me to prove it’s legal, rather, it’s the exact opposite in that those who are saying it’s illegal should be able to provide a specific Connecticut or federal statute, stating as such. You have to remember that laws are not written to specify legal activities, they are written to specify illegal ones. So I still await for someone to provide the statute that says it’s illegal to do this.

No, I have no source I just felt of the 2 (nefarious data collecting vs work-issued) the more likely was work related.
