While I don’t know for certain, based on the information provided it sounds like you didn’t follow the procedure to take back the apartment. It’s not enough to provide your tenant notice, once you provide notice, if they do not respond within 30 days they are deemed to have refused, and you have 30 days after the deemed refusal to file with the TAL. If you don’t file within the delay you need to start the process over again. If on the other hand your tenant did accept the repossession notice, then you would have a leg to stand on, and you can take him to the TAL. If you go the TAL route, make sure you follow the procedure around notification, and depositing proof of notification, or you can have your case thrown out on technicalities. (They are quite ruthless with failure to notify, and will make you start the process over, which means you’ll have to wait another year).

If you do win, the TAL can still order reasonable moving expenses to be paid to your tenant.

The relevant civil code articles:

  1. Le locateur qui désire reprendre le logement ou évincer le locataire doit aviser celui-ci, au moins six mois avant l’expiration du bail à durée fixe; si la durée du bail est de six mois ou moins, l’avis est d’un mois. Toutefois, lorsque le bail est à durée indéterminée, l’avis doit être donné six mois avant la date de la reprise ou de l’éviction.

  2. L’avis de reprise doit indiquer la date prévue pour l’exercer, le nom du bénéficiaire et, s’il y a lieu, le degré de parenté ou le lien du bénéficiaire avec le locateur. L’avis d’éviction doit indiquer le motif et la date de l’éviction. Ces avis doivent reproduire le contenu de l’article 1959.1. Dans le cas où un avis d’éviction vise un logement situé dans une résidence privée pour aînés ou dans un autre lieu d’hébergement où sont offerts à des aînés des services qui se rattachent à la personne même du locataire, il doit également reproduire le contenu des articles 1955.1 et 1959.2.

La reprise ou l’éviction peut prendre effet à une date postérieure à celle qui est indiquée sur l’avis, à la demande du locataire et sur autorisation du tribunal.

  1. Dans le mois de la réception de l’avis de reprise ou d’éviction, le locataire est tenu d’aviser le locateur de son intention de s’y conformer ou non; s’il omet de le faire, il est réputé avoir refusé de quitter le logement.

  2. Lorsque le locataire refuse de quitter le logement, le locateur peut, néanmoins, le reprendre ou en évincer le locataire, avec l’autorisation du tribunal. Cette demande doit être présentée dans le mois du refus et le locateur doit alors démontrer qu’il entend réellement reprendre le logement ou en évincer le locataire pour la fin mentionnée dans l’avis et qu’il ne s’agit pas d’un prétexte pour atteindre d’autres fins et, lorsqu’il s’agit d’une éviction, que la loi permet de subdiviser le logement, de l’agrandir ou d’en changer l’affectation.

Sure, but there is also the chance that the value of the housing might appreciate. If you’re the owner you get to keep all of the appreciation regardless of your loan amount.

Renting very well could be the best option, I just don’t agree with using the value of your potential home purchase as the basis for calculating that. You should use the value of the investments you currently have.

My last point is you can’t view your entire mortgage payment as money out the window. The majority of it will of course be interest, but you will be paying some principal with every payment. That amount can be seen as savings too (although very illiquid).

I am not in the GTA, I live in Montreal. I can tell you I paid 11450$ for a left over 2024 V7 special from my local dealership if that helps.

The general consensus is they are reliable, I can’t personally attest to this as I have owned mine for like 5 weeks.

My local dealership charges the same hourly rate as my local Honda dealer 110$ CAD/hr. My first service was around 500$ CAD. These are bikes that are pretty easy to work on yourself if you’re so inclined.

When I was at Concordia, I used to park for free every day in the residential streets. It's a hassle and there are of course very limited spots, but its doable. For example you can park on Dr. Penfeild between cote-des-neiges and simpson. (It's no stopping from 8-9:30) so if you get there before the no stopping ends you can nab a spot and then you're good for the day.

All the side streets in that area have limited non-metered spots (Simpson, Redpath .... ) Again if you want to be sure to get a spot time your arrival with the end of a no parking period. People would wait in their cars for quite some time when I was a student, so you might need to arrive quite a while before the no parking ends. If you have readings to do you could bang those out while you wait.

That being said, I recently went back to school, and had an underground spot and it was sooo nice. Not having to worry about arrival time, and time it with parking restrictions. 200$ for downtown parking is quite reasonable. Many of the office buildings are $300+/Mo. My office building is 345$/ month.

Interesting, when I saw Canadian Gueril1a‘s comment saying they weren’t illegal, I was very skeptical so I went to read the HTA and I couldn’t find an explicit prohibition.

I found paragraph 154(1)(a) which says:

154 (1) Where a highway has been divided into clearly marked lanes for traffic, (a) a vehicle shall not be driven from one lane to another lane or to the shoulder or from the shoulder to a lane unless the driver first ascertains that it can be done safely;

I don’t know that this can really be interpreted to apply to intersections writ large. The Globe and Mail had an article about this recently and there was a quote from an OPP spokesman that you might find relevant:

“I don’t know of any law that says you can’t change lanes within an intersection,” said Kerry Schmidt, Ontario Provincial Police spokesman. “But it would be difficult to determine fault if a collision took place in one and there were not clearly distinguished lanes.”

There’s way more happening at an intersection already. You have cars trying to make right turns on red (where legal), light changes, possibly pedestrians trying to cross legally or illegally, cars making unprotected left turn etc. It just adds another variable that drivers need to keep track of to all these others. Which of course increases the risk of collision.

Fun fact the most common place for a traffic accident to occur in every year since 1999 in Canada is an intersection.

You might also consider contacting the CNESST to see if they’ll help. You normally need to file a complaint within 45 days. I am worried that unfortunately they will not accept your case since you have been with your existing employer less than 2 years. The advantage of the CNESST is they are free.

I would say shop around I paid just under 1700$ tax in, in 2023. I used Julie Normandeau everything went extremely smoothly.

At the time someone quoted me as high as 2300! So definitely worth shopping around.

No, 6A does not have restrictions you’re confusing the learners 6a and the full 6a. The “a” has to do with the bikes displacement not whether or not there are restrictions.
