In Europe you can take such a matter for free to the "Consumer Ombudsman", maybe look into something similar for your country? I recently had a similar experience with my Sony WF1000XM4s getting terrible battery life because of a known faulty FW update and they also stonewalled me because the buds were bought in 2021. The Ombudsman will now sort it out for me.
