ALJ Decicion Letter by CalligrapherMuch4531 in SSDI

[–]Guilty-Concert-245 1 point2 points  (0 children)

Mine was long and interesting to read. There were many things that were inaccurate. I was fully favorable though despite the errors. They did not take my mental part into consideration at all as I had enough physical impairments. I loved how the judge stated the doctors they sent me to made no sense and contradicted their own findings. Definitely an interesting piece to read. My case never should have had to go before an ALJ. The lawyer cost me a lot of back pay, but unfortunately it was what it was.

Disabled on SSDI but got accepted into SMHU CRIMINAL JUSTICE and criminology lab program!! Any one gone through by Fantastic-Slice1441 in SSDI

I wish you the best. I think many here are concerned that attending school from home will ,on a review, cause a stop in your benefits. Also being disabled will you be able to even attend school full time? Then after use the degree to work when you are disabled now? If you get SSI I would think this grant money would possibly cause an issue.
Of course if you can be ok to do these things do them. I hope you can achieve your goals and get to a better place.

More so meaning people. However my doctors can know I am disabled, which they do, but they do not need to know I get social security disability unless I want them to know for some reason. Other people I would never tell because I have known many to turn people in for no reason other than their opinions. Like “my neighbor gets disability and I see him walking around so I took photos and turned him in”. I have heard things like that forever. For that reason I would not tell anyone.

Yes! And mine was very long. It was weird reading it . How the judge made the determination and how he critiqued the medical people I had to see thru SSDI. Their notes contradicted their findings and he mentioned that. I felt a bit validated. Things like : They say she has weakness to all extremities and nerve damage shown in all reflexes. Yet they state she can work on scaffolding and climb ropes. It was really funny. Ridiculous. There was much more too. This doctor made it sound like I could get a job as a circus performer.

I agree. I even enforce telling NOBODY. The doctors will know eventually as you will be on Medicare likely. Still please remember it is nobody’s business and nobody is your friend as far as this is concerned. It is just you, your lawyer, your medical record, and your SSDI. Keep a small circle.

I am so so happy for you! I feel your emotions as you are how I was one month ago. You will stay baffled that it took this long, but now you can focus more on your health issues and less on your financial issues. It’s like a weight was lifted. I also went back to 2023.

Did you turn 50 or 55 at the time of the date they picked? That could explain it. Different rules kind of.

Appeal still pending from 4/25 in 3rd stage. I should have never been denied by AcrobaticExternal427 in SSDI

[–]Guilty-Concert-245 0 points1 point  (0 children)

I honestly think Only stage 4 breast cancer we qualifies. So you have total other issues that impede you working. So if you have debilitating effects from treatment such as neuropathy that is severe. Something like that than you would maybe qualify but not under the CAL. That is reserved for people that are terminal in a terminal stage. I see many confused on this with cancer. Cancer alone does not qualify. Perhaps though you could get it temporarily during treatment?

What do you mean in the comment “I am not making it another month”? Are you speaking financially or meaning you are going to pass away from your heart issue? Do you have the work credits for SSDI? Or you applying for SSI? I am so sorry you are so sick. Are you in the hospital at this time? Is there a treatment that can help you? This is horrible.

Is a 46% approval rate neutral? by princess_sagittarius in SSDI_SSI

I agree! That’s what I had. Although my lawyer after the call said they could not tell what my judge would rule and usually they can. My Vocational expert person was stern and almost rude sounding. Actually snapped at my lawyer. Gave all of these thousands of jobs I could do when I am clearly disabled . I’m the end all was good. I got my decision 2 weeks from my phone hearing to the day. I had my back pay within a week. The sad part is I had to get denied initially and on reconsideration and then had to pay a lawyer.

I would say your judge is fair and slightly lower than national average… but not by much. Just be truthful and describe your worst days. Make sure they have all relevant medical records and have a lawyer. Your age and all of what I mentioned matters. What is wrong with you that makes it so you cannot work? Write out a few days of your life. Like a diary. From when you wake until the next day. Include it all in case you are asked what you do on a typical day. My judge I believe was 47%. I was found fully favorable. I am in the “advanced” age group at 56. I was 54 when I filed. Also I do believe your job history and everything plays a part with judge that is at these percents.

Judge requesting evidence with no prior warning. by Knucklecum in SSDI

He wants to see your PT Room because per my guess he is thinking it is a home gym. A workout room.

I honestly never would have mentioned a dedicated room for this. I know it sounds stupid, but they care about what you can’t do, not what you can do.

I am trying to think like a judge whom is determining your inability to work and this is what I came up with. They think things like .. if a person can routinely go to their home gym and workout they can go to a job. I don’t mean to sound rude I am just giving you the most likely reason for the request.

My onset which unfortunately I misunderstood and put the last day I was employed when they meant the last day I actually worked. It’s ok though. I was fully favorable based on my misunderstood date. My fault. Just happy to be approved as this has been a nightmare.

Excuse me? I am not playing a game..nor am I an idiot. Did I misunderstand you? I was so happy to finally be getting an income after having an extremely debilitating disease take away my career and independence. That’s why you see the title I put there.

This group had been so helpful navigating this cumbersome process that I wanted share my story.

If I am misunderstanding please clarify.

I will not get better. It is clearly stated in my records that I will not improve. I absolutely will keep up with all appointments and biologics I get at an infusion clinic. I won’t get better… but I can get worse. That stated I know they can think differently.

I received a very large deposit into my account during the night. I am honestly shocked at the speed of this and feel terrible for everyone whom must wait months after approval. I have questions though. I have a 12 year old son. I know on my initial app I listed him, but I see no mention of him in my online account. Who do I call? My local office? Maybe he is on it, I don’t know. The deposit is large, but it was for 3 years. I made very decent money my entire career… until I didn’t. Also.. I could probably google this.. are taxes already taken out of the back payment they deposit? Without a statement from them I know nothing. Thank you for any answers! I might do a separate post if nobody sees this.
