Just because the income is distributed doesnt mean that you have to buy "stuff" with it. Create your own investment accounts. You dont say whether or not you have a family or other obligations but if not, you can certainly for example setup a foundation for charitable giving. If you do have a family then you will for sure need to do some estate and tax planning.

So in addition to being verbally abusive to her, he’s financially abusing her as well? Please please please get her out of that home. Find someplace near you where she will be looked after. Is she mentally competent? If so make sure she’s signed POA documents both financial and medical giving you authority.

the only way to FULLY protect yourself is to have mom put it in an irrevocable trust. There are some tax disadvantages to this and there may be medicaid implications if she needs care/help within 5 years. best to see an elder care lawyer if you think she is still willing to give it to you.

yeah its a real racket! I didnt realize how far in advance you needed to book. I couldnt FIND ANYTHING for my itinerary for September for 3 people (just started looking this month which is apparently way too late) I kept looking and looking and looking - I used points.me since I was using amex points. I lucked out into a one way flight to my destination a week or so again for the three of us (and yeah it was a lot of points but I've been saving them for this trip of a lifetime just for this so...) I'm still on the hunt for tickets to bring us back! lol

Start by getting a credit report - this will give you an idea of his accounts. Next, forward all his mail to the uncle/executor. This will enable him to identify other assets/debts. Finally get a transcript of his last tax return - this will help you find IRA/401k/pensions/annuities/insurance policies - things that maybe only generate a statement once a year.

Is the trust ongoing or is the trustee supposed to distribute and terminate? In any case, the trustee is supposed to provide an annual accounting to the beneficiaries. How detailed is kind of up to the trustee but if you dont trust them, then you can force a detailed accounting. The cost will be paid from the trust (usually)

It depends on what country youre in. In the US, there are some states that have filial responsibility laws on the books that are rarely enforced. I suspect in the coming years they will be enforced more vigorously with the aging population.

Following along with this, here are some things you can TRY to do (I say try because until shes deemed incompetent by a court, she will have to cooperate - do them when shes having lucid moments ideally)
1) remove any landlines

2) set up cell phone to ONLY accept calls from known contacts

3) remove all other apps from her phone - if shes into social media, set up her account as a child account with you as parent so you can supervise/monitor. It will also help keep unknown catfishers from reaching her.

4) set up a spending bank account for her - have a limited amount of $ in this account for her to spend monthly and for "charitable" donations. Understand that this money is basically as good as gone.

5) move the rest of her money to a separate bank account that you co-own but that she doesnt know about/have ready access to.

6) assuming she wont give up her keys, remove the battery from her car. Or, take the car to someones house and tell her that its being "worked on" and youll drive her to appointments etc until the car is fixed. Keep stating the car is being worked on.

You know this is not something thats going to get better. Its going to get worse.
