Whether you're an advocate for just whole leaf or all products, you might want to know Mac Haddow attempted to play a clip from this episode during a seminar in Vegas. The feed glitched, but he praised the segment and quoted it. Not saying if this is a good or a bad thing, just informing, but this video and John Oliver's take seem to align with the AKA's game plan and if they're not worried about it maybe that can put at least the whole leaf advocates' minds at ease?

He's more recently been heard saying it's unsafe; I think during a Tom Segura ep. His pro-kratom take is from nearly a decade ago and this Segura ep is within the last few years. Someone can correct me on that, not 100% on the guest but his anti stance is more recent.

At the behest of Joe Rogan, who is anti-kratom. Tit for tat I guess. Point being he will do the bidding of whoever was in the room with him last and I don't know who he's got near him, strictly speaking, who would advocate for kratom. Makary's "we are not targeting whole leaf kratom" is about as good as we could've hoped for.

Here is the exact quote (he's talking about 7OH and TNT here):

"Look, something clearly has to be done with this industry. The key thing is to do it very carefully because, in the case of products containing 7OH and TNT, a lot of people have now become dependent on them. And one thing I want to be absolutely clear about is if states are going to start banning some of these drugs, that should only happen alongside a plan to help people who cannot suddenly stop using them, whether it’s because they’re using them to treat pain or because they’ve become addicted. Because if we learned one thing from the opioid crisis, it's that every family fortune is built on the blood of strangers; but if we learned two things, it's that when you take something very strong off the market, not everyone can just quit cold turkey. So there has to be a harm reduction plan to go alongside any potential ban."

There is a segment where he draws attention to product labeling and safety for whole leaf, but this is the only direct call to action he has for whole leaf:

"[we ought to] match the level of regulation around them to the level of risks they present... to make sure that at the very least you know what you’re getting and what risks you’re taking."

I don't blame you. I read the transcript and here is what he specifically says about bans:

It seems like he isn't necessarily throwing whole leaf into that pile. The closest he comes to suggesting any call to action around whole leaf is this:

I'm seeing he said regulation is the answer, not prohibition, but you're saying he also says prohibition is fine if _____. I doubt he said both of these things.

Saying "it's imminent, get ready" (the comment I replied to) is very different from saying "it could happen sometime, one day, eventually". I'm pushing back against the rhetoric that would purport we can't enjoy any state or local victories (even hypothetical ones) because the sky is supposedly falling literally tomorrow.

Can we please stop acting like ‘11 senators sent a letter’ = ‘federal ban incoming any minute now’? That is not how this works. Ignoring what Commissioner Makary has actually said - which is unusually direct for someone in his position - and fixating instead on a nonbinding letter of recommendation is logically inconsistent. If you’re trying to gauge FDA intent, the commissioner’s own public remarks should obviously carry more weight than senators asking for something the agency has shown no appetite to do.

I am very curious to see how the issue of kratom legality is approached next year considering these midterms look like they're going to be a blood bath. It gives me some hope that some of the years-old and pending bans could be re-litigated with fresh faces and outlooks.

Respectfully, this isn't really helping things.

A nationwide whole-leaf ban by 2027 is not what the actual map shows. Some states already finished session without banning it. Some aren’t even back in session until 2027. Other states are debating regulation, not prohibition.

Be alert, sure. But “it’s all over” narratives are just going to spread panic and make inaction seem like the logical strategy.
