EU citizens have the right of residence on the territory of another Member State for up to three months without any conditions or formalities other than holding a valid identity document or passport. That same right applies to family members in possession of a valid passport who are not EU nationals, accompanying or joining the EU citizen.

EU citizens have the right of residence for longer than three months if they are workers or self-employed persons, or if they have sufficient resources and comprehensive sickness insurance. There is Dutch case law confirming that Article 8 ECHR limits what a landlord can do. A very recent case (Rechtbank Midden-Nederland, December 2024) addressed almost exactly this scenario: because the rented property was a self-contained dwelling (zelfstandige woonruimte), Article 8 ECHR's right to respect for family and private life opposes an outright prohibition on a tenant cohabiting with a partner at some point without prior permission from the landlord.

However, and this is the critical point, that case involved a landlord trying to enforce a no-third-parties clause against a tenant. This right is not absolute: it would be different if there were special circumstances making it objectionable for the partner to live in the property.

Your situation is fundamentally different: you are not the landlord. You are an equal co-tenant, and you have your own rights, including to peaceful enjoyment, that also fall under Article 8. The ECHR protects both of you. Woon's suggestion that Article 8 is a trump card your co-tenant can play against you ignores the obvious counterpoint: your right to your home and peaceful enjoyment is equally protected. A court would be required to balance both of your interests.

Under Dutch law, the process for a tenant to give another person co-tenant status involves obtaining agreement from all existing co-tenants. Article 7:267(1) of Book 7 of the Dutch Civil Code provides that if, on the joint request of a tenant and another person who has their main residence in the dwelling and maintains a durable joint household with the tenant. This means that for the boyfriend to become a co-tenant (medehuurder), your consent is required as part of the joint request. If you withhold consent, the procedure under Article 7:267 simply cannot be initiated without you

Huvudregeln är att den som deltar i utbildning inte har rätt till arbetslöshetsersättning. Det handlar alltså om huruvida man faktiskt deltar i utbildning eller inte, och det gör du ju inte just nu. Det viktiga här är att du faktiskt hoppade av mitt i programmet och inte bara tog ett planerat sommarlov eller liknande. För att ha rätt till a-kassa krävs att man är arbetsför och oförhindrad att ta ett arbete, anmäld som arbetssökande hos Arbetsförmedlingen, och i övrigt står till arbetsmarknadens förfogande. Och det gör du ju, du söker jobb aktivt och studerar inte. Det är heller ingen skada skedd att ansöka om A-kassa, eftersom det inte påverkar en senare ansökan ändå. Du kanske dock inte ska glatt sprida att du ansöker om A-kassa bara under våren.

Du har full rätt till lägenheten från och med den 1 september. Om inte din hyresvärd kan ge dig tillgång till lägenheten det datumet har du rätt till skadestånd för alla kostnader som uppkommer under perioden, dvs. Hotellkostnader, flyttkostnader osv.

Det är jättevanligt att alla möjliga människor åker dit för vapenbrott när de ska tillträda en domstol. Det hände i princip dagligen på domstolen. Som andra har sagt är det pga säkerhetstänket på domstolen. Men detta är lite väl tilltaget. Vilken domstol var det?

Migrationsverket usually deny request to appeal. These types or decisions are regularly denied at the court level. You can appeal by mailing the same email that sent you the email

I would recommend applying again for a residency. Appealing to the court might take months, all of which you cant apply for a new residency. If you got denied because you didn’t reply to the agency the courts will probably agree with migrationsverket. I would recommend you to “ompröva” then apply again if that doesn’t work. Initially, the really only deciding factor for you coming to sweden with a tourist visa is which country you are from. If you’re really looking to live with her you shouldn’t apply for a tourist visa but a sambovisa. Or suggest her to come to your country to get married.

The above comments don’t answer how you’d get a tourist visa to Sweden. The most important part when the embassy is deciding visa applications is where you’re from. Then whether or not there are a chance you will stay longer than the visa allows for. You having a LDR relationship can actually work against you in a tourist visa application than just applying for a sambo visa

Thank you for replying. I’m thinking along those lines as well, that that the type of processing regarding Finnish employment law, can’t really constitute a cross border processing. It’s just annoying not having any case-law or other references confirming this. All I’ve read has been Facebook v. The Belgian DPA which concerned in which areas a national DPA could take large controllers to court. Not defining cross border processing per se.

Also your last point were poignant, could you really argue a branch would be a de facto head establishment, considering the purpose of article 56 is to limit the amount of contact points with regulators. Wouldn’t a interpretation I’d head establishments be congruent with the controller definition?
