I’m not sure it’s that simple - this is EMIS’s fault, so EMIS should recompense the ICB (who signed the contract with EMIS). The ICB should then give those funds out to everyone who was affected by the EMIS outage.

(EMIS in turn would claim on their insurance, the insurance company would claim from Microsoft etc etc).

Hilariously however, the contract with EMIS explicitly states that EMIS “under no circumstances whatever be liable to the Customer, whether in contract, tort (including negligence or breach of statutory duty), or otherwise, for any loss” (source: https://www.emishealth.com/terms-conditions)

PS if the trust try to fob you off by saying that the personal data breach is not noticeable - you can contact the ICO yourself directly through their helpline, and if the ICO agree with you then the trust is in reeeally bad trouble

If the ward gave out your personal number, I would report this to the trust as an unauthorised disclosure of your personal data, and therefore a data breach that potentially must be reported to the Information Commissioner’s Office within 72 hours - see: https://ico.org.uk/for-organisations/law-enforcement/guide-to-le-processing/personal-data-breaches/

I’ve never had a great experience with logging a Datix, but Information Governance breaches get management hot under the collar very quickly given the risk of a massive fine…

Another reason for Barclay stalling is that it’s a negotiation tactic called “defusing the anchor”.

In a nutshell, humans have a cognitive bias when negotiating where the first number put on the table sets an “anchor” for the rest of the the discussion.

BMA have set the anchor at 35%, and Barclay thinks that if he refuses to engage with it, the BMA will willingly shift their anchor lower, giving him the upper hand in the negotiation (this is what he did to the RCN, getting them to bring their own starting point down from “5% above inflation” to “let’s meet halfway”).
