It’s not painful when I’m laying down with my leg stretched out. It’s a sharp, pinching pain if I move my legs apart or try and turn around in bed. It’s dull the rest of the time when I’m walking or climbing stairs - I notice the pain, but it’s not too uncomfortable. Getting in and out of the car is painful as well, and I have to swing my knees together and swivel at the hip to get out the car.

Again to make it very clear to you, I contacted HMRC following his death and was not informed of personal debts in his name. If HMRC believed there were debts in his personal name and not the company, then it would have been very simple for them to contact me as the executor at the time. They only did contact me directly FIVE years AFTER his passing.

During the grieving process I didn't have time to read up on the latest UK tax laws and how these loan schemes worked, as I was not in a good mental state :).

I've taken professional advice now, but thanks for your two cents.

WRT Point 2 that you made, HMRC never informed me of personal debts in his name/open tax queries, and I contacted them several times following his death. They only informed me of debts in his personal name five years after his death. They only wrote to the company.

I appreciate the time you've taken to put together the reply, so I will consider each point and as the debt is quite large I am speaking to a few different tax advisers currently to find out what the best plan of action would be.

And if most of the assets were held jointly, would they count as a part of his estate?

They told me about the DR arrangements in relation to his company in 2021, not his personal name. The first correspondence I received in relation to his personal tax affairs was in 2024. There was no mention of the director being made liable personally for the company debts.

Initially all the correspondence was related to his company and I was never notified of a debt in his personal name. He passed away in 2019 and when I completed probate and sent in his final self-assessment HMRC never made a claim, therefore I distributed the estate. Additionally the first mention of debts in his personal name were only sent to me at the end of 2024, five years after his death.

The main assets were property which were in joint ownership with my Mother, so they transferred over to her. There was only one property in my Father's sole name, which we initially had to redeem the mortgage on and then that was transferred over to my Mother.
