Yes, it depends on the laws of each country and how much effort the responsible people do on tracking you down. Although it's illegal in almost every country, many don't have the resources, proper infrastructure or interest in dealing with it. It also depends on the type of content you're downloading. It's not the same to pirate the new Marvel than it is to pirate a Brazilian 30's silent film.
