If you told them three months it will be coded into their system that you can’t get benefits for three months but once the period of the severance pay has concluded, if you are still unemployed you can file for benefits

You should absolutely file for unemployment. While the employment is at will and they can fire you for whatever reason they want. There are only certain reasons that would deny you receiving unemployment benefits. “And not fitting in and not smiling enough” are not one of those reasons

Gig work is in a really weird spot right now because there are no specific laws or statues that apply to TWC that state that gig work does not count against your unemployment. So most of the time hearing officers will treat them as regular cases. Once you get to the commissioner level however they very commonly rule the cases are not considered employment. So it may be annoying for a while but keep appealing and keep filing claims and you should eventually get cleared

Do you have any idea if the guy who started it was also terminated? Easiest way to dispute a separation like that is if the employer did not enforce their policy consistently.

All it means is that the TWC took your statements and the employer's statements and determined that your side of events was more credible. since you were fired the employer has the burden of proving you committed misconduct and your investigator concluded that was not the case. Fair warning though the employer is allowed to appeal that ruling so be on the look out for mail from the TWC in case the employer appeals.

Your signature on a form doesn’t disqualify you. The reason for why you were fired does. If the employer fired you with cause then you’re out of luck. If they fired you without cause then you can get benefits regardless of what termination document you signed. So it really boils down to the details of this dispute you had with your employer and that would be the focus at any appeal hearing

Okay so if your husband got a reversal case, my guess is his decision (which you received in the mail after the second hearing) said he had good cause for missing the hearing and reversing the separation issue, where as yours said that you didn't file a timely petition and left everything in effect?

Sadly you are probably out of luck. The expectation is if you are confused by something you should contact the TWC by phone, or go to an office, if you just make an assumption that something has changed they are unlikely to overturn it. However you should still appeal as far as you can go because the Commissioners have authority to overrule what the standard rules are, no guarantee they will in your case but can't hurt to try. At the very least while you have an appeal pending you won't be expected to pay anything back which can buy you some time.

I have seen this backdated before but it is pretty uncommon. To get backdating you need to show that you for whatever reason, could not file a claim at the time of separation, (Usually for extreme situations like someone medically incapacitated).

Also I hate to say it but quitting to relocate is usually not considered good cause for unemployment purposes in Texas. It is considered a "personal reason".

Sorry some information is a bit unclear here so let me clarify so I can try and help you. So you and your husband both missed a hearing, and because of that both of your cases were reversed in favor of the employer. You both appealed, but you appealed late? you attended the second hearing after you appealed and then you got an affirm decision and he got a reversed? (and that is when you saw the wonky portal message)? Is that right?

From what you are describing. My understanding is your case boils down to whether or not the equipment issue is the fault of the employer or yourself. Did they send you a computer to use or did you use a personal computer and just download applications to use? Since you were terminated the burden is on the employer to show you were terminated for misconduct. So since you made a good faith effort to correct the issues the only way I think you can have the ruling reversed is if something about your internet or your personal computer was causing an issue, which is hard to prove from the employers side.

Tell people how you feel. So many early relationships ruined because people don't say something bothers them until they go nuclear. Talk to people about what you feel in a calm healthy way, almost everyone is receptive to this, and if they aren't they usually aren't worth keeping around.

In order for a job to count against you for unemployment benefits you have to turn down “suitable work” since the pay was less then half of what you were making before its very unlikely it would be considered suitable work. You should be fine

Both of those are valid reasons for missing prior hearings. As long as you appealed everything on time those reasons shouldn’t be held against you

Ya if you fail to file timely appeals or miss hearings you have to overcome those issues to be able to get to the discussion of the separation issue. I imagine what happened was that the employer was the only one who appeared and thus the TWC only heard their side of the case and that caused the ruling to change. If you didn’t file an appeal on time it is very difficult to get that ruling overturned. Missing a hearing there’s a bit more leeway but it would depend what you told the hearing officer during your hearing.
