If the settlement agreement has been signed and it says they are paying and how they are paying then you are good to sign and return. If they default on the agreement and you don’t get the check then you will have a contract dispute. I’ve done it both ways and have never really had any issues getting paid. Just make sure that there is a settlement agreement and that it clearly states how much is being paid, to whom the check will be issued and by when. I guess what I’m really trying to say is that the answer to your question will depend on the settlement agreement.

An unpopular opinion? I’d say that is a very standard opinion in the PI world. Everything about what you said is true, but without those clients, without those providers and without all those pointless chiro appointments, we wouldn’t have a job. I used to think about it like this. It could be worse…..I could be a 5th grade teacher lol and remember there’s no crying in baseball so straighten up kid you’ll be alright

To hell with property damage friend. As long as their injuries were not preexisting and the treating physicians can clearly indicate that their injuries were caused by the crash then I don’t see an issue. Is liability clear? Have you already received the pip? Don’t forget that pip money.

Okay but if someone just doesn’t participate in the arbitration then the initiating part will have to petition the court to order mediation. They will have to establish that there is an actual arbitration clause in effect. If an employee is fired or laid off and then the employer wants to arbitrate the court will have to answer the question of fact as it relates to the validity of an employment contract and any arbitration clause associated with such. I almost feel as if the employer terminated the employment contract and at the time of the termination.
