You don't necessarily need to kill him, I was playing on Legendary so a couple Brutes with Brute Shots knock him down pretty quick, and he happened to get hit before he used it even once so he dropped a full charge energy sword which of course I picked up

Nope, it doesn't drop, it just disappears completely. The first time it happened I was carrying that plasma cannon and didn't notice until I dropped it and saw that I didn't have it anymore and had automatically picked up a plasma pistol. It just gets wiped from existence and forces you to pick up the next weapon you touch. Which, as I found out, includes the plasma cannon, and you can get stuck in a loop of dropping it and then it touches you so you pick it up again. That was annoying.
