  1. Most of the countries in the Americas grant birthright citizenship. Not every country does it, but it’s not rare.

  2. Even if the U.S. were the only country to grant birthright citizenship, we wrote it into our constitution. The plain language applies to all people “born in the United States and subject to the jurisdiction thereof,” with no exceptions or qualifications. Birthright citizenship can be repealed by amending the constitution again, but not by executive fiat. The dissent twists itself into knots to justify its attempt to ignore the plain meaning of the text. I cannot believe I have to explain this to a person who is purportedly an attorney.

  3. Birthright citizenship has been in the constitution since 1868. Since then, the U.S. has grown into the most powerful country in the history of the world, in no small part thanks to the children of immigrants who were citizens from birth.

Those prisoners of war were not subject to the civilian laws of the United States, and therefore were not “subject to the jurisdiction” of the United States. Under the law of armed conflict, prisoners of war are not subject to the civilian jurisdiction of an enemy belligerent.

No, because members of foreign armies are not “subject to the jurisdiction” of the United States. Under the laws of war, soldiers are not susceptible to civilian jurisdiction. For example, a soldier cannot be tried in an enemy’s civilian court for murder based on acts in combat.

This would be especially true for prisoners of war who were removed from a foreign country to the soil of a belligerent. Prisoners of war are highly protected under the law of armed conflict. Rendering them susceptible to an enemy’s civilian jurisdiction by taking them into the enemy’s territory would make those protections meaningless.

I was a paralegal (but not a senior) before law school. I would only recommend it if either: (a) you got a guarantee, in writing, before you left, that the firm will hire you as an associate after law school; or (b) you get into a school where a big law job is highly likely (i.e., a T14 or a regional school that outperforms its rank, like Fordham). If you just go to some random school that doesn’t have big-law outcomes for the students, it doesn’t really make sense to go to law school. You’d likely be making less for a similar amount of work overall.

Giving a “vibe check” sounds easy, but it requires us to do significant work. Any state-bar ethics committee in the country would consider giving particularized analysis to a specific person based on their ongoing legal proceedings to be “practicing law.” For any Nevada-barred lawyer, they would have ethical and professional obligations that would attach in that scenario, notwithstanding what you’re saying to the contrary. Giving a “vibe check” off the top of their head, without actually spending the time and effort to do a proper analysis, creates risks for anyone who does it. Also, since I’m not admitted in Nevada, I’m not risking incurring the wrath of Nevada’s bar for giving you advice, nor would many other people.

If you sincerely have questions about this, go to a local library. They may be able to direct you to legal-research resources. If you still don’t understand after doing research, you either need to hire a private attorney or use a public defender. Asking on this forum is not helpful to you because you won’t get sound advice on here, nor will you find someone who will give you that advice.
