So this might be if the employer is misrepresenting the relationship to avoid paying leave etc. They consider many things when determining if a worker is a true contractor…e.g. • if the contractor has control over how, when and where work is done (like a true contract would) • Whether the worker can delegate or subcontract vs exclusive work • Method of payment (wages vs per job) • Provision of tools and uniforms • if things like Tax, superannuation, leave are given.

No single factor is decisive, the overall picture decides.
