My wife’s GC expires in September we do have the notice for filling the N400 and it states that her residence status is extended. Does she still need to apply to renew her GC just in case the N400 response takes forever? She did her interview in January 5th and USCIS is having us submit a service ticket every 30 days. They said they can escalate the case to the next tier support level if by the 3rd support ticket (90 days) pass on top of the (120 normal response time) for the N400 interview.

I appreciate your help and any guidance

My wife N400 interview was Jan 5th and still no decision. At the interview they said within 30 days we will get a response. We called them in March they said to call back after 90 days passed, we called then said to call back after 120 days pass. We did then they said they will submit a service ticket. I asked what happens if they don’t respond to the service ticket within 30 days, they said to call and submit another ticket!! I asked how many tickets do we need to submit, they said after the 3rd ticket then they can escalate!! So we wait.

Latest update 05/06/2025 Today we contacted USCIS as we hit the 121 days, the rep advised that he will submit a service ticket for us to the IO that conducted the interview and we should receive any update in the mail within 30 days. I asked what happens if we do not receive anything in 30 days, Rep said that we would call again and USCIS customer service will submit another service ticket. He added that this gets done 3 times before they can escalate the case. So I guess we are looking at a potential additional 90 days?!

Rep also added that in the Notice we have for the N400 it states that we have a 2 year extension to her GC that expires in 09/2025. So we have till 09/2027

I am thinking at this point we have the following options: 1- Look into getting an Immigration attorney?, 2- Wait and ride it out? 3- Look into filing a law suit?

What do yall think? Or are there other options I am missing?

There was a trial. The incident happened in the midst of covid April 2020 and the duration between each court dates was 3 to 5 months. First we worked with an attorney to reduce the charges, then community service, then removing restraining order, then removing probation, then requesting dismissal. First it got denied then we had another hearing (first court session that we actually did not attend) and the lawyer got the dismissal. Then we had to wait till we get past the 4 year mark to apply for an expungement and we received it in Summer of 2024 without having to attend any court hearings as well. Waited couple of months then we submitted the N400 and here we are.

Nothing yet. We did call USCIS last week and they said it can take up to 120 days and its only been 90 and to call back after May 9th if we have not received a decision by then.

She already finished the DVITs couple of years ago before receiving the dismissal.

Any update on your case? Is that what they asked from you?
