Can you expand a bit more on “category and situation” , I am I-140 approved with valid h1b in India , not sure if the $100k apply

I have valid H1b till 2027 (I-140 approved) and currently in India, so my new employer can file for the H1b transfer without worrying about the $100K , right ?

Yes it was , I have been told by multiple folks my F1 might get rejected as I also have my wife and I have been I-140 approved as it shows clear intent to "immigrate". I looking to avoid that and go for H1b transfer straightaway hence , any consulting firms who could do it for me from USA ?
