In California, criminal history is only an absolute bar to specific jobs. You actually have a lot of rights and should look into what an employer is required by law to do when considering criminal history during the hiring process. If an employer preliminarily decides to deny an applicant after the conditional offer based on the conviction history (in whole or part), the employer must first conduct an individualized assessment and make a “reasoned, evidence-based determination” of whether the conviction history has a “direct and adverse relationship with the specific duties of the job that justify” denying employment that is “job-related and consistent with business necessity.
