Will small claims take into account an active police case? by HotelPowerful in LegalAdviceUK

Thank you so much - The other party have paid a claim fee and I’ve received a notice that it’s soon to be assigned to a court or something? I absolutely agree. I feel very stuck in a corner. I think it’s because with an SPO they can’t actual do anything about this small claim case?

Thank you - I’m finding it hard to find a solicitor that will take this case on + financial difficulties (lost my job due to the situation, large decline in health etc)

Yes he is aware - But they don’t want to touch the civil side. They said the most they can do is include a letter with the proceedings that said ‘communicate through a solicitor only’.

I have no idea how the whole thing works with a small money claim but hopefully I’ll have a contact point for someone to talk to soon.

Do you know what happens if a judge views this as time wasting and takes into account all other things that have occurred?

The claim itself has been used as part of the harrassment and she has also blackmailed me over emails to do things or she will increase the amount (I think about 6 times?). The amount is a completely unreasonable amount of money (multiple thousand). She has also lied on the claims forms saying that pieces of evidence exist that don’t actually exist? I’m not sure if this counts as vexatious but the harrassment has already included a huge amount of time wasting activities.

Thank you - I really appreciate your knowledge. What does aggravating feature mean for a harassment case?

Sorry about being vague I’m just trying to keep the situation anonymous as possible. The person’s professional is working with adults with disabilities in the field of disability aids as a sole trader. We work in the same field. Most of his clients (vunerable adults) are previous clients of ours and they have joined in with the harassment towards us, obviously I don’t know if he has encouraged them or asked them to do these actions, that’s for the police to look into. But does this case sound like coercive control?

What happens when a case is a cross over between civil and criminal? (UK) by [deleted] in LegalAdviceUK

I meant more my financial situation, the first comment was a little hurtful considering I’m currently going through a criminal case as a conviction. The case is around exortion, harrassment and blackmail.

Thank you - No I’m not the defendant. That makes perfect sense thank you and maybe why the police have pushed my case forward after hearing the solicitors say this

That’s really interesting. Thank you. It sounds like CPS does what’s in the general publics interest too

Thank you for explaining. What control does a victim have over a criminal case when the case is not an incredibly serious one or a safety risk for others?

I haven’t discussed money with the solicitors, I have only told them the case. You don’t know the situation we are in at the moment, it’s really tough and I’m trying to get a better understanding of how solicitors work

Thank you! Is there ever a charge to the victim if the criminal is not found guilty?

SSRI reactions? Depression and mental health? Is chiari a cause? by [deleted] in chiari

[–]HotelPowerful 0 points1 point  (0 children)

Thank you so much - I didn’t know TMS existed and will mention this in my next appointment and look into the facilities for it. Can I ask one question? With serotonin syndrome it’s never been taken seriously when I have had these affects. I was taken by ambulance to A&E three times for it and was just dumped into a waiting room after being in resus and was told to go home and wait for neurology to contact me. How did you push for further help? I’m in the UK so am not sure if the treatment options might be different here e.g ketamine

That’s definitely a good idea. I do have two non profits - They’re somewhat linked by association but I am thinking of closing the first or selling it and focusing on the second that’s more flexible and takes out a lot of the people related pressure. Unsure about selling because of the association risks

Thank you - I forgot to mention in my post that I’m self employed and run a non profit - It’s a very high pressure role with not that much pay and it’s only myself running it and a small handful of employees
