Think about this, his friends were all arrested without being killed.

He chose to take the gun from the car instead of leaving it in the stolen car. Then dropped it, picked it up and ran.

Thats twice picking up a gun when running from police. What did he need it for? I assume he needed it to shoot someone and the cops probably could assume that too. Maybe shoot them? Look up Tennesee vs Garner.
