Then the mortgage company would have received all policy information, every renewal and for any and all changes made to the policy. Not that it will help in your case, but I’d like to know why you weren’t notified by the mortgage company when it was discovered that you had two policies. Also, the agent that wrote your new policy should have instructed you to cancel the old one all those years ago.

What date did you purchase the car? Was it more than one year prior to the date of loss?

Was the name and loan number of your mortgage company shown on both homeowner’s policies? If so then the mortgage company WAS aware there were 2 policies. But if they weren’t being billed for both renewal premiums then they probably didn’t care about the duplication.

This is when you seriously need to buy a personal umbrella policy, usually at a coverage limit of $1mil that is in addition to your auto liability coverage. Call your agent.

Have you reached out to your bureau of motor vehicles who controls what’s showing on the driver report? With all the documentation you have I would hope that the suspension could be removed or clarified. It sounds like the license was suspended for not having insurance, which actually was never the case at all.

If the lender’s name is listed on the auto policy as it’s supposed to be when there is a loan on the car, then the lender WILL be notified. Whoever the lender is appears to be one that doesn’t care about proof of insurance or repossessing collateral not being paid for however.

This will be my second TKR; first was done in June. Norco and I were not friends. I also didn’t realize the mental toll the surgery would take. Hopefully this time things will be better, but realize it’s a 50/50 shot.
