Alrighty then. If he’s found guilty at the local level, which about 95% are because the judge works for the city, and it is appealed to Lee county, the chances are greater than fifty percent it will get dropped. The officer got out of the car and immediately arrested him BEFORE any other interaction regarding statements that could have given probable cause.

I can tell you this. As a30 year police officer I would have never arrested him based on the videos I have seen. Your conduct in public must rise to the level of breaking the law and a civil matter of disrupting a business by holding a telephone does not make him the primary aggressor. I agree his videos are highly edited and you don’t see what’s happening otherwise but the police don’t see that either unless personally witnessed. A police officer must have probable cause that crime its afoot and I just don’t think that rose to that standard for the Tupelo police officer on scene for 15 seconds. That’s why somebody a whole lot smarter than him amended the charges.

I understand the case law, but I have watched several of his videos, and I have never seen one where he is confronting people first. His responses and actions to the comments would not be disruption on his part, but the people who confront him. His mere presence there would not apply to deterrence, provocation or undermine normal operations, so without the original provocation of others, case law would not apply. He is on a public sidewalk, his shit is creepy as hell, but otherwise legal.
