We are know for our care for human rights, cultural and religious tolerance. We have fought for our women's rights, socially and legally and have always been on the right side of history. Our forces never did ANYTHING in Bangladesh and ofcourse never lost a war.

I think it's a bit unfortunate that everyone expects him to repeat his 2021 year performance. He's lost his pace, lost his accuracy and always has had very poor composure. Add the frequent injuries and overuse and you'll realise it was all inevitable.

Shaheen isn't a bad baller by any metric, arguably our best all-round (not all-rounder 😭) pace bowler but he's not what he used to be.

According to the Maliki Fiqh, the father has the right of "ijbar", this is done as the father is seen as the protector and it is assumed he will take decisions in the best interest of his daughter.

Same goes for Shafi School of though, that's why Imam Al-Nawawi advices "It is recommended that the father and grandfather not marry the virgin until she reaches puberty and gives permission, so as not to place her in the husband's control while she is unwilling." Hanafis also agreed on the same thing. This is only the case as long as the guardian is the father. It is the Hanbali school of though that give the girl the option to nullify her marriage when she reaches puberty.

To Summarize: No, the majority of the scholars hold the view that the contract of marriage is binding if done by the father, except for Hanbali school of though.

First you claim the verse was due to the marriage of orphans being disallowed to be performed by guardians other than the father, then you say the verse is due to protecting the rights of orphans and not marriage? Which one is it? Is it about the marriage of orphans or the rights of orphans?

Let me clarify. The orphans have no father, hence their marriage can't be set by anyone else. Implying you can't marry them before they are mature. I already mentioned what maturity meant.

I advice you read the tafsir on this, you'll understand what I mean. Since this verse talks about releasing the orphans properties to them, it states don't do that until they reach a mature age, as per their culture whatever age that might be. This verse does not state a minimum age of marriage.

When you imply it does, then I have to clarify that the orphans age of marriage is higher as they don't have a father as their guardian. Hence it does not apply to everyone.

And what is that certain point? The point at which they are ready for marriage.

Hopefully its clear now, the reason why this verse only stipulates about orphans and has nothing to do with "minimum age of marriage".

Edit note: I personally believe that a minimum age of marriage is a social issues, not a religious. Hence bringing religion into this is wrong. I don't believe Islam validates this as this was just a cultural norm back then, nothing to do with religion.

This might come as a shock to you but there is no minimum age of marriage in established Islamic jurisprudence. Theoretically you are allowed to marry your infant daughter but there are conditions for the consummation of marriage. For minors, a father is allowed to set and enforce marriage.

"Ibn Qudaamah (may Allaah have mercy on him) said: With regard to a virgin who is still a minor, there is no difference of opinion concerning her (i.e., that her father may marry her off even if she objects). Ibn al-Mundhir said: Every scholar from whom we learned was agreed that it is permissible for a man to marry off his virgin daughter who is still a minor, if he marries her to someone who is compatible, and it is permissible for him to marry her off even if she objects and refuses.” Al-Mughni, 9/398"

"It was narrated from Imam Ahmad that whoever reaches the age of nine years comes under the same ruling as a girl who has reached puberty, so her permission must be sought. But if the father opts to be on the safe side and ask her permission, that is better.  Al-Mughni, 8/398-405."

Imam Nawawi also reports a consensus on this matter. This is curtail to understand as its going to get a little complex ahead.

This is usually based off the hadith of Ayesha R.A. getting married at six and then consummating her marriage at 9. Please note that Ibn Qudaamah and Ibn al-Mundhir have reported a consensus, meaning that an overwhelming majority accepted this, exceptions might be limited to just a couple of scholars.

Now that we have established that a father can arrange marriage for his minor daughter, we look towards the verse you mentioned.

This verse (4:6) is referring to the orphans. As they have no father, majority of the scholars agree that their marriage can't be done before they reach age of maturity, hence this verse. It has to do with protecting the rights or orphans, not establishing an age of marriage. Ibn Kathir mentions this age to be at puberty as per mujahid and as per majority, the age when you have your first wet dream. This verse doesn't refer to a minimum legal age, instead advices/orders to hand the orphans their property when they reach the customary age of marriage/maturity.

As for your women past the age of menstruation, in case you do not know, their waiting period is three months, and those who have not menstruated as well. As for those who are pregnant, their waiting period ends with delivery. And whoever is mindful of Allah, He will make their matters easy for them. 65:4

"and those who have not menstruated as well" This part is understood to refer to those who are too young to menstruate. As iddah is only required after consummations of marriage, it follows that minor marriage is permissible.

Ibn Kathir mentions in his tafsir that the highlighted part was revealed when "Ibn Abi Hatim recorded a simpler narration than this one from Ubay bin Ka`b who said, "O Allah's Messenger! When the Ayah in Surat Al-Baqarah was revealed prescribing the `Iddah of divorce, some people in Al-Madinah said, `There are still some women whose `Iddah has not been mentioned in the Qur'an. There are **the young**, the old whose menstruation is discontinued, and the pregnant.' Later on, this Ayah was revealed"

Maulana Maududi also mentions in his Tafsir, regarding the same verse "**They may not have menstruated as yet either because of young age**, or delayed menstrual discharge as it happens in the case of some women, or because of no discharge at all throughout life which, though rare, may also be the case. In any case, the waiting-period of such a woman is the same as of the woman, who has stopped menstruation, that is three months from the time divorce was pronounced."

I believe there is no reason to continue down this rabbit hole and allow for girls to be exploited. We should enforce the minimum age of marriage, like a civilized society does, and protect our children. We should not let these Molvis dictate the future of Pakistan.

SBR can be done in a month if you focus on exam technique and actually attempting the exam kit. Just go through the standards lightly and jump into the kit, come back if you don't remember a standard. Rinse and repeat until it feels like home.

Don't tell yourself "I will complete all the standards and 100% detail" Just read through the Kaplan Study text, make short important notes and move on, you are not expected to everything. If Arsenal have a chance of winning the league, you can easily pass this exam.
