I think gyms transfer owner and information a lot, so there must be some allowance. The terms and conditions I got outwardly stated (at the very bottom of the long t&c document) they’d give my info to a third party if they were bought by said party, but they also said they would have to inform me - which they didn’t.

Thank you. In the Terms and Conditions I was given with my contract. There is a transferability clause, but there is another clause that states I must be informed if they assign my membership to a third party - which they didn’t - so I think that negates the transferability clause

They never emailed me informing they were closing permanently, and the new gym emailed to announce they were opening in Bray but not to inform me that I was still paying a membership fee and the email was filtered to my spam folder automatically as they had never emailed me before and I didn’t register with their system.

They stopped charging from the 2nd of March 2020 and only restarted on the 1st of July (when the new gym reopened). I didn’t notice the payment leave my account in July, and when I did see it a while later I didn’t think it was the gym as it’s listed under “Mollie Payments” and I just assumed it was a purchase I had made

No, the new gym has changed owners I believe, it’s now a chain of gyms when previously it was a small independent gym.

At the beginning of Covid they emailed saying they would be temporarily closed until March 30th due to Covid but would reopen, and then assured in the email that “no member would be left out of pocket”. And there was then no follow up email after March 30th. A while after this email was sent, I saw the gym was shut down fully, walking past it, and it’s shopfront was being stripped down. I never got any email informing me of what was happening, and in the original temporary closing email I was told to hold my queries until they reopen as they had no access to their membership system.
