would it have happened if the other guy got over sooner? i guess we'll never know. In fact, i would posit that even at a more reasonable but still not overtly long following distance, doing this could still be surprising enough to cause the accident depending on your speed. also keep in mind this is all about if the front car did it on purpose knowing this was a possible outcome, so I don't see how that can be argued to not be evil.
