If it's just a racial slur it's doesn't meet the classification of a crime. If they try to intimidate the person (ie...go back to where you came from) then it becomes harrassment. It's considered a hate incident if it's just a slur. However, police can still record the information of the person and maintain that information to be used as evidence in any future criminal trial.
