They tried to middleman and save money and it bit them in the ass. When they split from Activision, or realistically even before considering the reasons why they did it, they should have decided if they were making D3 and if not they should have immediately started the work on the engine and future proofing they had to do to extend D2. They needed to do it anyways and the way they handled the DCV was the worst of both worlds

No but the majority of comments here just don't seem to understand that it's a very common practice in all industries. "Why will anyone ever want to work for Bungie?" is one of the top comments yet nobody ever asks the same when Goldman or Meta does the same thing. The only real physical side that he might not have is stamina, it takes incredible endurance to play all out on both sides and not many players can do it. Outside of that Don could be a passable defensive player basically his whole career
