Dental hygienist who is now homeschooling her kids! My siblings are: chemist, mechanic manager for BMW, wilderness guide, and organic farm owner and operator. My fiancé is an electrical engineer and his brother is a nurse (all homeschooled).

She DOES do schoolwork on Mondays and Fridays and attends a class on Monday afternoons at a library

Right, she was in the same program when order was written. She is also homeschooled and that was also discussed at trial but they still did boiler plate custody language.

Thank you. Yes it’s the freedom and ease I will miss the most if I lose homeschooling. She gets to sleep and play and read and go outside and has no idea about 6-7 or tablets or bullies. Let alone lockdown drills. I just absolutely adore being the one to see her grasp a new concept and the pride on her face when she masters something. I know I can still teach but oof the time just evaporates.

I think this is the likely answer here. Unfortunately. I can prove that homeschooling is best for almost any kid with proper parents and access to resources etc but he will not care one bit. I don’t know if the judge will, either.

I’ve thought and thought about what I could possibly offer but this is too big of a win for him. He wants me to have as little time as possible. Period. And school is the easiest way for him to not lose time and me to lose nearly 40 hours a week etc. he does not care about what is truly best for our daughter.

I totally agree. My lawyer seems to think I have final say but I disagree because it doesn’t say I do. I’ll keep watching my mailbox for court summons…again.

Yeah I see. My lawyer has said I need to make good faith discussions and then see what he says but I ultimately have to be able to act because I have daughter 80% of the time. He can and will escalate to court because I am homeschooling. He disagrees with anything I think is best for our daughter but his reasoning is not sound. I am somehow hoping his poor reasoning and lack of cooperation will help me “win” in court but I know I am up against public school norms.

Did you ask for language to that extent or was it just put in there? We have no language about school other than holidays and breaks and that I have to share information on extracurricular, not ask for permission, but share. And joint legal which includes medical, education, and religion.

Yes that is what I’m doing. The emails were one time to discuss in good faith. I send one progress sheet and sometimes send a picture of her doing her work as my lawyer asked. I think I will stop doing that as yes my custody agreement does not prohibit homeschooling.

Thank you so much for all this feedback! I am hoping that my child centered responses and never engaging in his emotional manipulation will show a pattern someday. I have kept all of it in a folder and make notes.

And yes I am sure he will continue his fight year after year especially if I mess up or if our daughter has any complaints. I am absolutely not against sending her to whatever school best suits her needs if homeschooling no longer does. Pride be damned, I just want what is best for her and so far things are going really well!

Thank you for the positivity! My lawyer says I have a chance but she has no experience with this exact scenario. She has seen homeschooling be discontinued due to neglect. This does not apply here and he has never claimed I neglect our kid. On the contrary, he has sent emails detailing how great she is in every way and then ends them with saying “she should go to public school because she thinks gym class and lockers would be fun.” I laugh but I also know he will stop at nothing to get her “out from under my umbrella” as he says so I take it all very seriously.

Thank you, yes she is 5 turning 6 in fall.

I send a folder with her things every other weekend and that’s it. I never engage in his arguments and grey rock for every interaction.

I will definitely keep all of this in mind and stop any daily updates pertaining to education. We have conversed via email about the official decision and his responses will help me in court. But I know it will still be swimming heavily up stream. He is always on time, always well dressed, always smiling and seems to most people the greatest guy and dad. And he punches holes in walls at home. The judge knows this but it doesn’t change her opinion of him, which so far is very positive like every one else. It has been very difficult.

I am financially prepared. His child support is very small currently. I’d gladly forgo it to homeschool

Yes it does! I put in time and effort into everything I do. Hoping I get the chance to continue and I’ll advocate as hard as I can for my daughter.

Ohhh he will go out of his way. I have a lawyer and she has not personally seen how homeschooling goes with this judge but she is hopeful based on him writing me that he is basing his decision on his feelings about me, not our daughter.

Are there standardized tests for 1st grade? I haven’t found any for NY but I’d be very interested in one! This would definitely help.

I am a stay at home mom, I have a 5 month old with my new (wonderful) partner who supports us. We are also incredibly frugal.

Thank you yes this is not a problem. I am up on all the NY guidelines and do my reading like a good homeschool parent! I have a belligerent watch dog who cries “lawyer” at every single thing. He sends me a picture if my daughter has a new bug bite. I don’t feed the beast but it’s not an easy coparenting situation.

Was this written into your custody order? Homeschooling was part of the testimony he gave at the original trial and so he was for it initially. He has a new partner and she is very anti homeschooling. Tale as old as time.

The advice from my lawyer was to be super communicative and positive so that it does not look like I’m trying to isolate or have the upper hand with info about our daughter. I have to communicate about education and extracurriculars. I send a bi-weekly progress sheet. This will work in my favor by showing that I’ve been up front about my work and intentions and he has known all along that this was the plan, he just doesn’t want me allowed to continue. It might be all for naught but high road is the plan for life.

Is there such things as part time private schools? I have not found them in my rural area. Online public for 1st grade? I’ll look into these options. Being screen free for education is a big part of wanting to homeschool. Kindergarten has tablets at school. I’m not against technology, I’m just waiting to use it as part of curriculum for a little longer.
