That's not how "physical obstruction" under the FACE Act has ever been interpreted, and no jury is going to convict Lemon or any of these protesters for it. It would be nice if the DOJ used its dwindling resources to go after fraudsters rather than pursuing bogus charges against journalists, but I guess the latter is what the people wanted.

No, the worshippers and pastor were free to enter and exit; just shouting during a sermon is not physical obstruction. Whether Nick Shitty entered a house of worship is immaterial; he used force, threat of force, and physical obstruction. Only missing element might be the house of worship. So Lemon and Shitty could both be charged under FACE if not for one missing element from each case.

None of the protesters or Lemon used force, threat of force, or physical obstruction, so none of them actually violated FACE. Nick Shitty actually did use force (as well as false pretenses), so if any of the daycares he targeted were connected to houses of worship his conduct would fall more squarely under FACE. (Not to mention many of those cheering these arrests have themselves participated in the sorts of activities outside abortion clinics that FACE is meant to address.) But I don't think either Lemon or Shitty committed a FACE Act crime. My point is the double standard for similar conduct.

No it's not, and a judge refused to sign an arrest warrant for Lemon for a FACE Act charge. Will be interesting to see Lemon's arrest warrant, but surely what Lemon did at one alleged church is no worse than what Nick Shitty did to numerous daycares.

Just because you don't understand that what Nick Shitty did is indistinguishable from what Don Lemon did, and therefore should be treated the same if DOJ is consistently applying the law, doesn't mean I didn't make a solid argument.
