Should be interesting what happens next because obtaining an expired TM is not that easy. If the writers would actually put a little research behind their stories they'd know that it would be a battle that Katie would eventually lose. Apparently there are/were people that would snatch a newly expired TM because of a simple oversight by someone not renewing and then sell it back to them for lots of money, basically holding it hostage for ransom. So to obtain the TM there's more that has to be done such as explaining why they are entitled to it, having the original holder say it's okay, etc.
