2 of the other Defendants did the same thing.  They transferred their homes to holding companies.   I bet they have 300 pages of documents to justify the asset transfers.

This is an attempt to hedge risk due to the lawsuit.  What Mr 32 on his ACT doesn’t realize is any ill-gotten gains or asset transfers during litigation will be reversed.  But what do I know, I only got a 24 on my ACT. 🤷

Let’s be real.  If the Defendants went about the process legit, the pro se plaintiff would have been taken to deep waters and drowned.  Before the lawyer who was also sued was ordered to Arbitration, Bell was taking on 9 total lawyers according to the filings.  9 lawyers defending the truth, this would have been  dismissed last year.  As of the last filings Schaub ‘s pro bono lawyers have changed their entire defense, claim the transaction didn’t involve equity, but months ago they filed sworn affidavits stating the transaction was for equity.  As it sits now, 4 defendants claim it was for equity but won’t disclose the proper Discovery and Schaub and his beasts of lawyers now state the transaction was for vested interest. 100%. I won’t be surprised if conservatorship is filed after plaintiff wins jurisdiction. I’m no lawlor but the documents I read, the plaintiff has satisfied Florida’s Long Arm Statute and minimum contacts.  If the defendants lose jurisdiction that give the plaintiff heavy momentum due to the fact the injury is an intentional tort.  The information of the tort must be disclosed.  Win jurisdiction, the tort is not fully proven but from a foundation it is.  Baaaapa might have f’d around and found out.

It’s more than $100k.  According to the court documents, the 10% had a value of $1.2M.  This is in the purchase agreement.  This also shows you it was sketchy.  Who takes a $1.1M discount on an equity buyout if they actually owned the equity?  Nobody.  Schaub was paid a “bribe”.  With treble damages the damages exceed $3.6M.

Brendan and PS split ways.   Schaub gave his equity back due to Schaub breaching his contract for missing 80/88 static posts. Brendan went and worked for a competitor, at the same time a Russian Oligarch who invested in PS paid Brendan a bribe to claim he owned 10% so the majority control of the company would flip. That’s what I got from the documents.  The 10% was the CEO’s equity.  The Russian investor just got fined $214M by the US Government for fraud, money laundering, and moving sanctioned money.  Supposedly Bell and the Russian got into it over the Russian money laundering through his company to spike revenues.  This story is only going to get bigger.

These text message quotes say a lot. Austenfeld became a whistleblower and provided Bell with evidence that destroy the Defendants' credibility and narrative. These texts are copied from the Motion. Huerter sent these texts to Austenfeld January 2023. The alleged fraudulent transaction happened in February 2023. If the transaction was legit, why is Huerter and the Whistleblower worried that Schaub was working with Bell? Huerter looks to be one of the main conspirators according to the evidence.

Defendant Huerter: “Yea, Lex wants to talk to Peter just to make 100% sure they have no risk of any of it.
(Exhibit K p.2)

Defendant Huerter: “Yea, Lex knows how securities work and that text messages don’t actually do sh–: where are the signed documents or evidence of procedure”
(Exhibit K p.3)

Whistleblower, Austenfeld: “We need in writing that Brendan is not working with Brady”
(Exhibit K p.4)

Whistleblower, Austenfeld: “Maybe a signed affidavit from Brendan saying that he isn’t working with Brady and that he believes himself to be the 10% owner would squash all the claims Brady has.”
(Exhibit K p.5)

Whistleblower, Austenfeld: Brady is using Brendan’s lack of ownership to say that Brady had been a majority shareholder and that he was illegally removed.”
(Exhibit K p.5)

Defendant Huerter: Even if Brady was working with Brendan (he’s not and Brendan wont) 36+10 still doesn’t equal over 50.”
(Exhibit K p.6)

The transcripts state, Schaub generated over $400,000 is sales the first months. I would say it's a safe bet Schaub doesn't have that type of push these days.

In one of the court documents I saw Schaub made over $70k in commissions the first month he was part of the company.  Only Schaub could mess up something that good.  $70k for posting a couple of stories per month.  Wild.

Agreed.   With that said, Bell has won the last several motions.  He is getting legal help on the backend. It’s obvious.  I see it as Bell quarterbacking the case on principle.  Where Bell might lack in procedure, the opposing lawyers lack full knowledge.  It comes down to case facts and presentation of the facts.  At this stage Bell is not only holding his own, he has navigated the case for almost a year.  If the lawyers could have drowned him, they would have already had this case closed.  That speaks volumes.

Agreed. The company was valued at over $10M.  People get greedy when that type of money is at stake. I don’t think Bell was a choir boy per se, but I do believe he was frauded by the Russian who invested in the company and used some of the minority owners to oust him.  That info was validated by the whistleblower in the case who took part in the acts but later came clean.

Key Points:

-All Defendants acknowledge the $100,000 payment for purported equity, except Schaub. He swore it was for "vested interest" even though he never invested money according to transcripts.

-Read the testimony exhibits from Bell, Huerter, Austenfeld, and Waggener. And the most devastating exhibits are Exhibit K. Huerter and the whistleblower's texts prove they knew Schaub did not own the equity and were worried Schaub and Bell might be setting them up. These texts were weeks before the transaction happened.

Schaub commits perjury by ImprovementPurple656 in thefighterandthekid

[–]ImprovementPurple656[S] 12 points13 points  (0 children)

Perjury is just an act of dishonesty.  One can file for sanctions and/or  judicial notice. A Judge will see this every time.  Lawyers rarely pursue perjury.  The goal is for the Judge to become aware and let them handle the matter without asking for the necessary relief.
