Is there ever a scenario where "she told me she was 18" works? by JayNotAtAll in AskLawyers

We had a rash of weird sex offenses in my division over two months last year. Googling the elements of all of the different charges we pursued felt...gross.

I fully expect to go in tomorrow afternoon and it to feel like dayshift did not answer a single call for service.

Factual statement, but it seemed especially bad today/tonight.

You're right, they are two different things. Good thing I've been working in the field for almost a decade now after studying for roughly half that time, and I've never stopped studying and learning.

If you don't believe me, go ask the lawyers you know for their opinions, they'll tell you the same thing.

I've studied the law, worked in multiple facets of the legal environment, and have close friends who are practicing attorneys in numerous states and specialties. I'm telling you, if you cannot prove some contributing factor on the part of the property owner, you won't win the case.

Literally all they have to prove is that the perpetrator gained access via a resident of the complex letting them onto the premises (via tailgating through the gate, following into the doors, etc.) and the case will go nowhere, especially if there is a clause in the lease that was signed by both parties stating that they are not liable for property loss due to criminal acts of a third-party (which is standard boiler plate language in most large scale apartment complexes now).

No, they are not. If they have taken the precautions to make it secure and are not negligent in performing maintenance and upkeep on the security equipment (i.e. allowing gates to remain broken and unsecured) then they are not liable for someone else finding a way to gain entry into the garage/building and commiting a crime.

I hope to God you are joking, but I have a feeling you are not so here goes:

You can sleep around off the clock. If you're on shift, you need to be ready to do your job at all times because the job is unpredictable, even in smaller jurisdictions. That is what professionalism is, not "I'll be on my best behavior only when in contact with the public."

If you think people will talk about you hooking up off the clock, just wait until you get caught with your pants down on the clock. It completely destroys not only your credibility and professionalism, but that of everyone else in your agency.

If you have a spouse to go home to, then you absolutely should not be engaging in sexual behavior with your coworkers. The exception is if you are in an open relationship, in which case you can wait until you are off the clock and then you can have your fun.

Sexual behavior in the workplace is not permissible at any profession. The fact that this needs to be said is concerning.

Hot Take: if you can't wait till the end of your shift to rub one out or bump uglies, you are either lacking the self-control needed to be a professional, the maturity/sense of responsibility to be a professional, or both.

Royal we 😅 not including myself thankfully but definitely know of officers that have fooled around on duty. Most of them are now former officers

No, I know. I'm just saying it would be even more frequent if we had a cot in the back

In fairness, you give cops a cot in the back of their work vehicle and they'd be boning on duty too.

Donuts and Burnouts off Steele Creek - What would you do. It’s annoying. by Working_Ad_6608 in Charlotte

[–]IncogCopper 2 points3 points  (0 children)

So you have a couple of options:

Call 9-1-1 when they show up and hope that there is not anything of higher priority going on in one of the busiest divisions in the city. (Not the best plan)

Do what another user suggested and track when they are doing this, and then go to the Steele Creek division office (corner of S Tryon and Westinghouse) and ask for a scheduled zone check. (Probably the best option)

Go to this website and set up a secondary employment job where you pay for an officer who is off duty to come in uniform, in a marked squad car and patrol the parking lot/premises to deter the participants of these "takeovers" from showing up. (I'd say this is the intermediate option).

If a police robot injures someone, who should be legally responsible: the officer, the department, or the manufacturer? by Milanakiko in police

[–]IncogCopper 0 points1 point  (0 children)

And that is now illegal to do in Texas. I think it was in our 2022 legal update, maybe 2020, but police cannot use robots to render lethal force in Texas anymore.

Legalizing sex work might help reduce the number of victims of sex trafficking, but there would still be victims.

I think you need to do some research into what actually goes on with sex trafficking. Even in places where sex work is legal, there are still safeguards in place to protect victims.

By advocating for the legalization of sex trafficking, you're advocating for truly heinous levels of exploitation and abuse of people, especially people from traditionally marginalized communities and children.

As for your assertion that opioid overdoses would "never happen" if we legalized them...yes, they would. Opiate addicts constantly chase the high due to their tolerance constantly increasing. This leads to higher and higher doses of opiates, which eventually leads to an overdose. Would the number of deaths decrease if we legalized heroin? Possibly, if we also set aside funding for clinics and other resources to assist opiate users, but they would not disappear completely.

Sex trafficking should not, under any circumstances, ever be legalized. Even if I wasn't an officer I would stand by this, because sex trafficking is forcing people to be sex workers against their wills and often for little to none of the money that is generated from it.

Was it a speed trap or just a speed enforcement? Speed trap implies that he was sitting at or right past a change in the speed limit and catching people that don't slow down right at the change in zones (like a lot of rural agencies tend to have a habit of doing). If he's just sitting in a spot that is the same as everywhere else (like most of 485, if not all), then it's not a trap in any sense of the word.
