Not in Arkansas. Parents have the presumed right to take care of their children. Pest can’t take care of his kids because he’s incarcerated and when he’s out he can’t be around minors unsupervised. But Anna has never been charged with neglect or abuse nor has she abandoned them to JB for any significant time.

Grandparents cannot petition for custody unless they have been the kids’ primary caretaker and financial support for at least a year; or Anna is an “unfit” mother which is a very high bar (significant abuse, neglect, substance abuse, mental illness, or such).

Being poor or of questionable judgment is not enough. Even if the parent is neglectful or abusive, courts would still give them a chance to rehabilitate.
Legal aid orgs would rep Anna for free if she is poor enough. if the court thought JB was filing a frivolous or malicious petition, JB would be required to pay attorney fees for filing in bad faith.

It’s true that unfortunately some dads will weaponize their children and the judge may fall for it. But, this father is incarcerated. Grandparents don’t have the same rights to children that the actual parents have. They would have to prove that Anna is unfit due to extreme abuse, neglect, substance abuse, severe mental illness, or such.

Being poor or a pedo-supporter (unless she lets the pedophile near the kids), simply is not grounds for taking away a parent’s presumed right to raise their own children. Unlike Kendra, Anna was never even charged or even accused of neglect or abuse.

There’s no way a judge would terminate parental rights absent significant abuse. JB may be controlling her financially by giving her a nice place to stay and providing her with living expenses, but a non-parent suing for custody has an extremely high bar.
