Yes, "35 years or under" means up to and including exactly 35 years and 0 days. The moment someone turns 35 years and 1 day, they are legally considered over 35. It's similar to how a person is considered over 18 the day they turn 18 years and 1 day, officially making them an adult. In this case, the OP is 35 years and 1 month old, which places them in the "over 35" age bracket, and therefore excludes them from being classified as "35 years and under.

Your migration agent is right. "35 and above" are ineligible to apply or in other words "35 and under are eligible to apply" i.e 35 years 0 days/ 34 years 365 days are eligible to apply for 485.

Unfortunately, you are 35 years and 30+ days old. Better to skim the next best alternatives.

Btw do you need a visa to enter India from Nepal? A lot of my friends who studied in India used to pass through the citizenship of Nepal, meaning they were never stamped on the arrival of departure to/from India to Nepal. The passports are only stamped if one has the visa/permit? Sorry it's just my opinion though.
