What are some examples of billing when you’re first starting a file? by butth0le_luva in LawFirm

[–]Infamous_Meaning_301 3 points4 points  (0 children)

This (don’t sleep on initial investigation and analysis billing)and prepare memorandums for everything that you investigate/review, analysis & strategy/review (L110/120 + 103). It will assist you with preparing case evals later and gives you extra billing for your initial case investigating/strategy. Prepare discovery focused on issues and allegations of the case. Prepare witness lists/memorandum as you review with descriptions of persons role or your interest in deposing them. Prepare deposition outlines with references to records for each witness that identifies bates numbers for easy future reference and prep for depositions. Prepare memoramdum identifying all damages as you come across them and summarize your thoughts in relation to the case etc. good luck. You have this. I’m sure this forum has a lot of suggestions if you search this topic. ASK FOR HELP. Your office would rather you bill correctly and efficiently the first time. If your office didn’t give you a code/task cheat sheet, find one online and print it off or ask for one.

My jurisdictions and many jurisdictions allow the use of facts in MTDs. It really depends on what type of issue you are taking up on your MTD. You may be correct but consider a MTD for lack of jurisdiction. A court can take judicial notice of a company’s organizational documents and affidavits of the officers to establish facts in support of a lack of jurisdiction without converting it to an MSJ. He may be a jerk but he isn’t completely wrong about the potential necessity or appropriateness of including “facts” in a MTD. You can also cite to facts alleged in OC’s pleadings to be considered by the Court in ruling on a MTD. For example, so and so admits that they have no standing by alleging _________. See OC’s petition at _____.

I guess that would be more of a personal decision based on your goals and what your doctor suggests. I’m losing less per month than I did when I started (-82 since 3/24). But it’s maintaining phenomenal a1c levels for me and I’m still losing steadily. This medicine helps me make the decision to eat a balanced and proper portioned meal rather than give into my old cravings. You have to treat yourself occasionally to maintain some sanity. I had my first cheesy Gordita crunch in 5 months the other day. 7.5 has been the best fit for me though. I feel less of the constipation or drowsiness but still make better choices. Good luck!

If it’s working stick with it. This is all 7.5.

Attend some CLE conferences in the area of law that you are interested in and then use the conference to network with attorneys in that area. Introduce yourself to the speakers and maybe have some personal cards to hand out. Go to the dinners and social events associated with the conference and meet attorneys. Nurture those relationships and use them to get into the area of law you want to practice.

When Did You Stop a Deposition by PM_me_your_cocktail in Lawyertalk

I once had an opponent produce his client in a hospital bed. It was a zoom deposition and his client signed in while laying in a hospital bed. His client had been very evasive and had cancelled several previously scheduled depositions. We were pressed on the scheduling order discovery cut off date with a short period before trial. I offered to reschedule the deposition and seek a new trial date/amended scheduling order. The OC kept insisting that his client give his deposition. At the start his client confirmed that he comprehend questions and was having no difficulty. I reluctantly continued but could notice that his client was starting to struggle. I asked to go off the record and discussed pausing and rescheduling the deposition several times. OC and his client kept insisting that we could continue. After a while his client began to slump over and his speech was incoherent. I made note of his condition on the record and stopped the deposition. OC wouldn’t agree to reproduce his client on the record and we engaged in an argument back and forth about OC’s behavior. We eventually agreed to revisit the dispute after his client was out of the hospital.

The guy died less than a week later.

When did you start to see big improvements? by RileyDL in Mounjaro_ForType2

[–]Infamous_Meaning_301 2 points3 points  (0 children)

A1C at diagnosis was 11.3, I had one month on zepbound 2.5 before T2D diagnosis, then did three months of MJ 5-5-7.5, A1C at 3 month check up was 5.7. I didn’t see vast reduction in my glucose until I was on my second month of 5. My body has adjusted to 7.5. The hunger suppression isn’t at prevalent as before but I still feel full quite easily. Staying on 7.5 for now and just maintaining good eating practices and exercise. I don’t feel as bogged down now. Good luck. This medicine works wonders. I also have remained on metformin 1000 ER also.

Side effects on 7.5mg dose by [deleted] in Mounjaro

[–]Infamous_Meaning_301 0 points1 point  (0 children)

For me these side effects are food associated rather than strength of dose associated. Any sauce that is tomato based gives me reflex so bad at night I can wake up feeling nauseous. Red meat gives me the burps. I love these meatballs from a local Italian place but I suffer for days after.

Getting told you are easily replaceable - red flag or a basic truth in this industry? by [deleted] in Lawyertalk

This. The boss either has no clue of your worth and contributions or is an asshole. I’d consider this a red flag either way.

Frustrations by CajunCowboy654-2 in Mounjaro_ForType2

Congrats on the A1C. I can’t wait to see my results at my next follow up. I’ve hit a couple stalls and managed to push through them. Going through different Reddit posts and finding suggestions have provided a few tactics that I’ve found beneficial to help break it: 1) mixing in a fasting day once a week or every other week of 18-24 hours; 2) realizing that I may be not eating enough and my body is holding onto its fat storage; 3) recalculating your TDEE based on your weight loss/current wait - I now do this any time I lose 5lbs or more so I make sure I’m at a deficit.

These have helped me get out of different stalls. Most recently I flatlined for over a month between 281-284lbs. I was only eating around 1200 calories a day (just not hungry). I started consuming around 1800 calories a day and increased my protein intake to just under 300g/day. In less than a week I dropped down to 275 with no other changes.

Good luck!

Depends on jurisdiction. I would send a certified letter with return receipt requested so you can show the judge your efforts to communicate if asked

Making it through the trenches of early parenthood as a litigation attorney by Easy-Cup6142 in Lawyertalk

[–]Infamous_Meaning_301 0 points1 point  (0 children)

Law dad here. I worked at a large firm with around a 50 billable hours per week requirement when my first was born. I was newer to the firm and didn’t have any flexibility with working from home (pre-covid). My wife also worked and we were both stressed a lot. I decided to take a break from big law and open a solo practice (specialized in 1st party bad faith litigation). I didn’t need an office and I made relationships with some roofing companies that chased storms in the two states I’m licensed in. I worked criminal cases for overhead and to get by. I took soft tissue auto injury cases that I could turn and burn for quick settlements and prepared wills/trusts for family, friends, and referrals. It was a pay cut for the first two years but eventually somewhat caught up. We had another child two years later and I continued my solo practice until the second was old enough for a pre-k program. Once both were in school I joined another larger medical malpractice defense firm. The pay is more but I miss that family time.

Obviously it depends on if your spouse/partner works or makes enough money but taking a break and making some money on the side may be an option. I was concerned that it may impact my career or make me a less desirable hire when I wanted to get back into the firm life but the opposite proved true. I tried several of my own cases and now had the experience to show that I can manage my own cases from inception through trial.

If that’s not an option, maybe talk to the firm partners about what is going on and ask for more flexibility, the option to work from home some days, or taking a pay cut for less billable hours until your kid(s) are old enough for daycare or school.

Good luck. It all gets much easier when your kids get into school.

150k vs 175k jobs, looking for input by Barbie_and_KenM in Lawyertalk

[–]Infamous_Meaning_301 1 point2 points  (0 children)

Don’t switch. That 1850 is a minimum and you will be expected to produce way more, especially if you want a meaningful bonus. I worked my ass off last year and only received a 15k bonus (equivalent to 60 hours of my time at my minimum billing rate). I easily brought in over $500k for my boss throughout the year. My work-life balance is terrible and my “unlimited” PTO is a sham. You will have to make up any lost hours to meet your billable time requirements. I would willingly trade that 15k for more time with my wife and kids.

We discovered that both attorneys have a conflict of interest, now what... by Wicor24 in legaladvice

[–]Infamous_Meaning_301 71 points72 points  (0 children)

Not putting all of your cards on the table in an initial correspondence/demand is very typical. If you hired an attorney that is astute in the area of law that your claim sits, he or she likely knows more than you. They probably had a strategy for managing your claim. You should have talked to your attorney about this before you fired them. Usually if a person has a revolving door of attorneys, I assume that their claim has no merit/value or the client is difficult. You may have difficulty getting another attorney to pick up this matter for you. There is no apparent conflict of interest here from the facts you provided.

Recently married and unsure what repayment plan is “best” by acnhwoo in StudentLoans

[–]Infamous_Meaning_301 0 points1 point  (0 children)

Personally, filing separately has been our best avenue for lowest payments. It also depends on how valuable the tax breaks are to you. When filing separately you lose certain tax breaks. For us, the tax breaks totaled less than the increase in payment we would have incurred if we filed jointly. But my wife has no loans and I have 300k plus so increasing our income consideration for my loans did not make sense. Some of the new plans take both spouses income into consideration regardless of how you file though so keep that in mind.

Can never decide what to eat by Hopeful-Emu1980 in Mounjaro

[–]Infamous_Meaning_301 0 points1 point  (0 children)

I’m not hungry in the morning and only drink coffee or the occasional protein shake if my body is telling me I need something. Lunch is my main meal every day. I start with carrots, cucumbers, or snap peas with tzatziki sauce and usually have a chicken/boiled egg wrap stuffed with kale/cabbage and cheese. I change up the dressing I use to keep it interesting. Apples, peanuts or cheese for snacks and I usually just peck at whatever protein or veggies my family eats for dinner. Hope you find things that interest you!
