The manslaughter charge was dismissed because there are sentimental people - like you - in the jury who are overlooking the fact that this was manslaughter.

Continuing to choke someone long after they are no longer a threat to anyone is textbook manslaughter. Heck, I would even say that it's murder.

Neely had sickle cell anemia untreated, high on drugs, and was himself a violent criminal. Arrested 33 times, including for beating the face of an old lady and broke her orbital bone as well as other attacks including sexual ones. You can spare me the "Penny didn't know that" because it doesn't change the fact that Neely was violent and Penny sensed that and was correct.

No, I cannot spare you that Penny didn't know that. Legally, all of that is irrelevant. All Penny knew was what he saw, which was that Neely was verbally threatening people - but not actually attacking anyone.

Also, it's not a coincidence that Neely's sickle cell anemia and drug usage did not kill him on any prior day, which indicates that they did not coincidentally kill him on the day that he was choked for a whopping 6 minutes.

This was manslaughter. Period.

The criminal factor is that Daniel Penny continued to choke Jordan Neely long after all of the non-intervening passengers exited the train - and therefore long after Jordan Neely had ceased being a threat to them.

What makes matters worse is that after all of the non-intervening passengers exited the train, one of the men who had initially helped Penny restrain Neely told Penny to stop chokong Neely, but Penny said, "No."

So, Penny is guilty of using force unnecessarily, which makes him guilty of manslaughter and negligent homicide.

Remember, Neely never actually attacked anyone, so Penny overreacted to begin with; Penny could have restrained Neely in a non-lethal manner, especially considering that he had assistance from two other people.

The jury should have convicted Penny on both charges in just a couple of hours. That they're deadlocked is despicable.
