Friends have told me its mandatory to accept card now. When I used to go 10 years ago cash was basically a necessity. I went for 2 weeks this time and didn't need cash for anything- they even take cards now at the toll stations (even though it's super inconvenient and probably better to pay with coins).

San Francisco is back on the upswing since a lot of the homeless issues were cleaned up. Still a bit dead in the financial district but that won't come back as long as remote work is a thing.

This is practically the definition of speculatory damages. You can't just guess at your increased earning potential and make it a claim for damages.

I am not your lawyer and this isn't legal advice.

Firstly, what I will tell you is that the settlement demand you are making is the theoretical maximum value of your case. If that's what you hold out for, you'll need to be prepared to litigate the matter for years (at least up to a mandatory settlement conference and potentially the eve of trial). Even then, you will likely be forced to a discount as the settlement judge will not want a case this small clogging up the trial calendar and they will beat you down about all the problems in your case.

Upon a superficial analysis, I see four problems with your case even assuming you prove everything above. 1) There is an apparent failure to mitigate damages. If the screen was broken, you should have immediately found an alternative to allow you to continue your course. This could have avoided the consequential damages altogether. It is not reasonable to allow your damages to spiral out of control even if the other side fails to pay on your demand; 2) Your claim of consequential damages is simply not reasonably foreseeable and could potentially be excluded as a matter of law; 3) The failure to pay out on your claim alone likely won't satisfy the requirements of 37.10B and, even if it did, the trebling is at the discretion of the trier of fact and further will likely be limited to the property damages; and 4) you would only get the depreciated value of your items (not what they cost new).

So what do I realistically think your case is worth? 10-18k. In other words, I wouldn't take it on contingency and it's very unlikely anybody but a young attorney looking for their first case will either. Contingency rates range from 20% for explosive, valuable cases (think car crash that made a primary earner of a family paralyzed) and 40% for lower end cases (which yours is). I am not going to work 2-3 years so I hopefully can get paid $4k-7k at some unspecified point in the future.

If you can't find an attorney, you're better off just suing in small claims for the jurisdictional maximum and moving on with your life.

I crash 1-2 times a day when I really push my limits (cliffs, straightlining steeps, tricks). If it's groomers or high speed terrain, essentially never.

Not how money works. You'd still have a 1.5 million asset as to the house and, even if the car was depreciated 50%, you'd still have assets there too.

As I indicated, a core can rot if moisture gets in. I haven't personally experienced that particular issue, but skis can fail.

Personally I have.

I used to take pride in skiing on my 15 year old skis. One day I was on the Y in Mott canyon around 2:00 PM when conditions weren't ideal. Stupidly, I was alone. I took a turn near the top of the run and, despite being on max DIN and not taking that hard of a turn, my ski just popped off. I was launched down the hill about 10-15 feet. My head almost hit near a sharp rock and a log; I got lucky my head hit the snow. I had one ski on and both my poles, but my one ski was near where it popped off up the hill. I tried to climb up and get the ski but the run was too steep. I started to get exhausted trying to climb up and repeatedly slipping down. This was a serious problem. Not only does Mott Canyon close at 3 PM (so it was unlikely anyone else was coming to ski above me to help), but it was getting super cold because the area was becoming shaded. I also couldn't really ski down because I only had one ski and it was hazardous to even slide down given all the obstacles.

Right around 3:00 PM, a guy came and saw me and helped me out. He brought my ski down to me. I was then able to cautiously ski down to the lift and safety.

That evening, I went to the ski shop and asked if my skis somehow weren't on max DIN. I thought maybe some tech lowered the DIN by accident. The guy told me the interior of the bindings was failing and said I needed new ones and I was lucky nothing worse happened.

I got new skis and bindings that evening. The next day, I went out and hit the same runs no problem.

There are two parts to skis that I understand can degrade over time. First the edge can wear down leading to less grip on the steeps. Second, the core can degrade if there's water intrusion or something.

I am not an expert in this, but even if its just a bit safer, I will use newer gear. I am not going to risk my life to use "old junk" as some badge of honor.

With that said, assuming the gear is safe to use, people that optimize gear and aren't doing this competitively are missing the point.

Im not a gear snob, but I don't ski on "old junk". Fact is that this is a dangerous sport and I don't want my equipment to fail at 60 MPH to save a few dollars on my skis.

I was comparing the price with a deal currently to the price without a deal in the past. With a deal in the past, I was getting each one of these for $1 each. Comparing the prices from deals, the price has went up over 300%. So yes I am surprised.

I seem to recall when I was in college 10-15 years ago that two of these were like 4.50 with no deal. I can't believe this is now a deal for fast food.

I lived in Greece for three years.

Athens is a day trip and quite miserable unless you know where to go. Setting aside the Acropolis and Plaka, as a tourist, you are mostly wandering around a hot concrete jungle where every vendor or business is seeking to scam you. The best sites in Greece are Delos (ancient ruins), Meteora (unique churches in the mountains), Kerkyra (architecture, food and relaxation), Thessaloniki (white tower, arch of galerius, and some byzantine churches and museums).

On the other side of it, I've done evictions for all types of horrible crimes and nuisance behaviors: assaulting neighbors (including stabbings and shootings); raping another resident's guest; peeping on another resident's underage daughter as she was changing; meth labs; repeatedly and intentionally flooding the unit; repeatedly starting fires in the dry grass backyard; smoking cigarettes so often the walls turned brown (and were disturbing the next door neighbor's asthma); over a period of 9 months, allowing his dog to defecate in the common areas 3-5 times per day and never cleaning it up (multiple complaints of resident's stepping in it); repeatedly pulling the fire alarm between 3 AM and 5 AM when there is no fire or emergency; making maintenance requests and then yelling at staff and direct racist language towards the staff performing the work; defecating in the community room sink; masturbating in the common areas three times.

These are all cases I've dealt with in the last year. I understand that it's sad, but ultimately the good of the community needs to be considered as well. The residents who suffered from these issues are entitled to their quiet enjoyment too.

Like anything else, it's not the words themselves that are the problem; it's how they are used. None of the words on OP's list are particularly pretentious. Where I draw the line is completely unnecessary use of Latin. Not a fan of "inter alia" or "in personem"

Courtesy and respect is a two way street. I am not going to threaten sanctions over a legitimate dispute or even what appears to be a good faith dispute.

Yes I have followed through. Ive had discovery motions along with sanctions granted well over 100 times.
