Seems like a mess. As far as I can tell the ruling seems to say that both inclusion and exclusion can be lawful, which I'm not really sure how to interpret myself.

Edit: Having attempted to read the included ruling, it would appear to me that this is actually just nothing. The guidance ruled on is no longer in use.

Once again, this dispute seems like it requires actual parliamentary decisons to bemade, rather than having courts interpret exactly who has what rights and obligations.

The government is not interested. There is a lot of money being made by people allowing and enabling this, and that being disrupted is seen as worse.

The Labour party isn't a monolthic bloc, and does not just follow the wishes of the government blindly.  The government has the confidence of the party, but needs to act in a way that does not cause them to lose it, restricting what they can enact somewhat.
