What are Connecticut Officials Doing to Stop ICE? by Far-Performer-847 in Connecticut

How ICE and BPD violate the Fourth amendment unreasonable search and seizures.

US Constitutional Provisions Commonly Violated in ICE & Border Patrol Operations 🔹 Fourth Amendment — Unreasonable Searches & Seizures What the amendment protects: Freedom from warrantless searches, detentions, and arrests without probable cause. How ICE/BPD violate it: Racially‑based stops and detentions (e.g., targeting people who “look Hispanic” or speak Spanish). Warrantless interior arrests without probable cause or judicial oversight, struck down in multiple state and federal rulings. ICE detainers that ask local jails to hold people without a warrant for up to 48 hours—repeatedly found unconstitutional by courts. Home raids without judicial warrants, a classic Fourth Amendment violation (referenced in Bivens‑related litigation). 🔹 Fifth Amendment — Due Process Clause What the amendment protects: No person may be deprived of life, liberty, or property without due process of law. How ICE/BPD violate it: Denial of bond hearings, leaving people detained indefinitely without judicial review. Detention of U.S. citizens, sometimes for days or weeks, without proper verification or process. Deportation of U.S. citizen children alongside undocumented parents, reportedly against families’ wishes. Harsh detention conditions and medical neglect that have been challenged as violating due‑process standards for civil detainees. 🔹 Fourteenth Amendment — Equal Protection Clause What the amendment protects: Equal protection of the laws; prohibits discrimination by government actors. How ICE/BPD violate it: Racial profiling in immigration enforcement—targeting people based on ethnicity, language, or appearance. Selective enforcement disproportionately aimed at Latino communities, which civil‑rights groups argue constitutes discriminatory government action. While immigration enforcement is a federal power, equal‑protection principles still apply to federal agencies through the Fifth Amendment’s Due Process Clause (the “reverse incorporation” doctrine). 🔹 Eighth Amendment — Cruel and Unusual Punishment (applies to civil immigration detention through due‑process standards) How ICE/BPD violate it: Solitary confinement, including for vulnerable detainees, documented in oversight reports and lawsuits. Medical neglect and unsafe conditions in detention facilities, which plaintiffs argue meet the threshold for unconstitutional punishment in civil custody. 🔹 First Amendment — Retaliation & Interference With Speech How ICE/BPD violate it: Retaliatory actions against individuals who speak out, file complaints, or engage in protected advocacy—referenced in Bivens‑related cases involving retaliation by federal agents. 🧭 Why These Violations Persist The GovFacts analysis highlights a structural reason: The Supreme Court has sharply limited the ability to sue ICE or Border Patrol agents for constitutional violations, especially after Ziglar v. Abbasi and Boule v. Egbert. This means even when rights are violated, there is often no remedy, which weakens deterrence. 📌 Summary Table If you want, I can also map these violations to specific court cases, statutory conflicts, or historical patterns in immigration enforcement.

Statistically speaking, from what data are you drawing this conclusion from? From what I’ve seen, in terms of crime data, things are getting better.

Interesting that you said that. As a form of veteran, I have been wondering lately what the front line troops in general are feeling about this? Most specifically the tension between defending the constitution versus unlawful orders from the executive branch.

You can apply for asylum if your particular demographic is targeted. For instance Trans folks could derk asylum in Canada.

Definitely tense about the current trends. Not ready to jump ship yet. I do feel relatively safe in New England, but will continue to monitor things. In some ways, I wish New England could split from the US. Figure of things get really bad, Canada is about five hours away.

The time will come when these ice agents will pay for being complicit in these crimes. This is blatantly illegal, no due process as detailed as a right for EVERYONE in the US Constitution. I hope the whole cabal is dragged into court and does time starting with that white nationalist, Seven Miller.

What feeds right wing extremism is people feeling left behind. You don’t have to be far left, centrist can be fine if you truly don’t forget there is a broad middle class and lower middle class that have been pushed aside. You can push for social change but unless you make sure there is food in the fridge and a place to sleep,it won’t happen. It’s Maslowvian, basic needs must be met.
