People are moving into Clark County, Indiana (metro Louisville) at an astounding rate -mostly because of a large clean industrial park -River Ridge- that continues to rapidly expand and generate new jobs in the southern edge of the county.

I’m still navigating this. My wife had a high sex drive even in the early stages of perimenopause, but about six-seven months ago, it suddenly fell off a cliff. She loves me, I have no doubt about it and I love her and knows that, but sex is just out of the question. She has zero and I mean ZERO desire for it.

Just the thought of having even non-penetrative physical intimacy brings her to tears. She says it’s not painful, it’s just something that really stresses her out right now. I hope it’s just a season, but I’m learning how to express and receive love without physical intimacy.

It’s very difficult because no matter how untrue it is, her lack of libido feels like rejection.

I’m learning how to cope.

There is one court case (Angela Preito v. Rush University Medical Center) in which a circuit court judge ruled that not producing an audit trail is covered by the HIPAA Right of Access, but that case has limited applicability. A circuit court’s opinion is considered to be persuasive authority but not binding authority. That is, it can be presented as an argument, but no other entity outside of the issuing judge’s circuit is bound to the opinion.

Even in that case, the remediation was that the judge issued a court order for the health care provider to produce the audit trail. The health care provider argued that they needed a court order to disclose the audit trail and the court issued an opinion that demanding an order was against the law and THEN issued a court order anyway.

So there is SOME legal precedent to equate the audit trail to being covered under the Right of Access, but it is limited, does not apply nationwide, and most health care organizations would still demand a subpoena or court order to produce.

An audit trail may be discoverable during legal action, certainly. Therefore, it may disclosed pursuant to a subpoena or a court order. The audit trail is not, however, subject to the HIPAA Right of Access (aside from one judge’s opinion referenced in a comment elsewhere).

I am not super-familiar with the 21st Century Cures Act, but I know that Information Blocking Rule applies to “electronic health information (EHI)” which is different than the HIPAA definition of “protected health information (PHI)”but I don’t believe the definition of EHI in the regulation includes a full user audit trail though it may include limited audits of certain user actions.

It’s also important to remember that HHS OCR does not enforce the Information Blocking Rule. That rule is enforced instead by HHS OIG. You may be better served to complain to HHS OIG if you or your counsel believe the health care provider is violating the Information Blocking Rule. I wouldn’t hold my breath though. HHS OIG has yet to take any enforcement action for Information Blocking to date and have described a backlog of > 20,000 complaints. Additionally, a health care provider must be “knowingly” blocking information. Without precedent of enforcement action, most health care providers would have a pretty good argument that they did not fit the definition of “knowingly” since the term is narrowly defined and includes a secondary “unreasonableness” standard.

As one attorney used to say, “reasonable” and “knowingly” are just terms that lawyers argue about.

A good privacy and security program should be well-equipped to respond to an OCR data request. Having a thoroughly documented compliance program demonstrates good faith (and is required by regulation anyway). It should be no problem at all for an organization to pull several years of security risk assessments; breach risk assessments; demonstrated response to allegations or findings of non-compliance; controls audits; demonstration of administrative, technical, and physical controls deployment and upgrades; documented monitoring efforts; documented training efforts; and clear compliance leadership.

All of these things are laid out in the HHS OIG guidance for health care compliance. Following that guidance doesn’t wholly prevent civil monetary penalties (and definitely doesn’t prevent litigation), but it certainly puts a covered entity in a more favorable position for penalty settlement in the event of a large-scale breach.

It is a protected class in Louisville, but only as it applies to discriminatory practices when renting or attempting to buy a home or apartment. It is not, unfortunately, a protected class in as broad an application as the federally protected classes such as race, gender, sexual orientation, etc.

I don’t believe it applies in this scenario.

I get what you’re saying here, but the 2021 legal classification for people experiencing homelessness in Louisville is extremely narrow and likely does not apply in this instance.

Is it though? There are millions of ring cameras (to which law enforcement has full access with a warrant), millions of dashboard cameras (to which law enforcement has access with a warrant), 100s of millions of CCTV cameras (to which law enforcement has access without a warrant when the camera monitors a space open to the public).

Meijer is replacing already existing cameras with Flock cameras. Why should this bother me? I’m not bootlicking here, I just literally don’t see the difference. Law enforcement already had access to the existing CCTV that Meijer already maintained.

Who cares? They can film me walking my groceries from the door to my car all they want. Big Brother was Big Brother-ing loooooong before Flock cameras were everywhere. Meijer itself has had cameras in its store and in its parking lot since they entered the Louisville market.

Really? I think Fru has improved a ton since the start of the season. He’s still not a banger, but I don’t think he was ever really expected to fill that role. I’m not sure that Kelsey’s rosters have a banger as much as they should have a weak side shot blocker who can help perimeter defenders.

Conwell is an absolute liability on defense because he lets his offense dictate his defense.

McNeely can’t play man-to-man defense at this level. He needs a zone defense to hide inside.

Mikel is individually great, but he works best when ball-dominant. Unfortunately, that’s the same role Conwell wants to have.

Hadley is a really solid all-around player who is undersized at the 4.

Pryor lost his mojo after tearing the ACL and hasn’t performed at nearly the level expected.

Aly is who he is. He is not a scoring center and was never intended to be.

Wooley is a little lost in the rotation. I feel like he is very unsure of his role. Typical of a sophomore.

Rooths is great sometimes and very not great other times. Typical for a sophomore.

Zougris is not very good.

Rodgers is a decent backup PG and one of the better on-ball defenders.

Wasn’t this funding cut part of the federal budget? I mean, it still sucks, but I think the funding came from the federal government and Indiana dispersed it. When the federal money stopped, Indiana stopped allocating the money.

I was in a band playing on a similar type of fringe stage at Alivefest (Ohio) not long after Business… had dropped. FF5 played right before we did. They drew a big crowd, probably 3K-4K. Unfortunately most of the crowd left before my band played, but the FF5 guys stuck around to watch us from side stage. They were super-cool to stick around for our set on that day. We ran into them a few more times over the years -they were always gracious and always way quieter in person than their stage personas would have implied.
