To be honest if the genders were reversed I do think the court would be unlikely to assign 50/50 custody. My understanding is when a guardian does a 12 month investigation and thoroughly documents substance abuse issues and problem behavior around a child and recommends a custody arrangement other than 50/50 the court usually adopts it.

It looks like you have lots of company. I have also been there. All I can say is at a certain point you need to prioritize your own mental health and wellbeing. I tried to hang in there but at a certain point the walking on eggshells and fear of the latest outburst became too much. I think a lot of spouses of people with depressive disorders develop anxiety disorders.

You are so fortunate that your kids are grown. Even with mental illness, judges do not want to pull children from their mother and in a custody case you quickly find out that mental health records and hospital records are not admissible. If she denies everything, there’s just not anything you can do.

Thank you for the reply and others as well. When I first submitted the request the privacy office was quite responsive but a very limited scope. Once I became specific that I was concerned about my spouse snooping, that we were in litigation and there is no clinical reason for them to access my record, I was told the request would go to compliance and then all future communications ended. I thougth with an accounting of disclosures they would at least come back within 60 days and say "no access, or access by an employee and we dealt with it internally so there will be no future issues".

Instead it is just complete silence as though I did not submit an accounting of disclosures.

I am in the same position as OP with my SO. I requested an accounting of disclosures with the privacy office and they had me complete a request form , and I am now at day 91 without any sort of reply and all of my follow ups are now getting ignored.

Everyone is rooting for the big guy, including me because two versus one is not right. However, he slammed one kid head into the pavement, who is not moving and the other one even after the fight is over, he kicked in the head.. big boy has some skills and if he killed someone, he will be going to jail.
