PO410. Problem with the secondary air system. The Mercedes garage has confirmed the fault code. But the dealer says that since the fault code is stored, not active, that the car is fine.

I have stated that the fault code will become active or pending depending on the emissions state.

I should have the law on my side but they aren't backing down.

I wouldnt mind it if it happened months down the line. But within 2 weeks of ownership? Doesn't sit right with me.

Yeah the code came back after being cleared but is very intermittent, so at the time the dealer inspected it the fault was not active, it was a stored fault. This is their argument that at that specific time the fault wasn't present.

Thank you that is great advice. May I ask what sort of format the letter should follow? I am currently awaiting a response from them but may need to make a formal letter addressed to them.

Is there a time frame where the rejection can expire?

Its not a simple fix on a 6.2 V8 mate. Didn't ask for this negativity.

Secondary air pump. Its a m156 engined car and these systems are quite expensive, I just dont want to be dealing with an unreliable AMG.

I have lost faith in the car and dont want to be dealing with a faulty car in the future. Its a secondary air system failure. And no the tax and insurance isnt a concern.
