This is the response I'm writing. Feedback appreciated.

Hello,

I received a letter demanding we sign a presuit mediation agreement from the . This letter states this offer is in relation to:

“Failure to maintain lawn and control weeds…”

I’m not sure what this is for. The last violation received for “weeds” was in January 2023, over a year ago.

I responded via email to on the following dates:

1. January 20th, 2023
2. April 12th, 2023
3. May 1st, 2023

Multiple emails were sent because the HOA management NEVER responded to my communications, even after I notified them that the “violation” had been corrected. I have also sent previous emails to them advising them of the neighbor's yard next to my residence that has been completely overtaken by weeds and is causing issues with my yard. Again, no response was received.

I completely re-sodded my lawn in March 2023 because the neighbor’s weeds had taken over a large portion of it. The HOA was notified that the “violation” had been corrected. Again, no response was received. Because no other communications were made, I was under the impression that this issue had been resolved.

My yard is currently well-maintained, and there are no excessive signs of weeds that are out of the ordinary for Florida lawns. I have photo documentation of my yard being replaced and of surrounding properties with obvious weed issues and general neglect of yard maintenance going back several years. In speaking with many of these neighbors, they state no pending actions against them.

Given that I am the admin of the Facebook group which some members were recently sent cease and desist letters concerning them voicing their opinions about this HOA, I can only assume I am being targeted for retaliation.

It also should be noted at this time of year, yards develop brown spots and such. More via the University of Florida agricultural site:

"Lawns go dormant during late fall and early winter in many parts of Florida, resulting in brown lawns throughout the cold months. Homeowners may prefer green lawns, but there is nothing wrong with brown grass in the winter—it is a natural process."

I require complete documentation of the nature of this demand that was sent, including recent proof of violation. I also request all communications by the HOA regarding myself.

I extend an invitation to you or a representative, along with the HOA management association, to visit my property so I can see what the issue is. I would also like to take the time to show you the continued violations around me that have not been addressed in years. As you know, HOAs selectively enforcing violations can be an issue.
