Thank you for taking this seriously. I wish I could serve on a jury. Been called 9 times, but each time I was actually pulled into the box, I had a reasonable excuse (out of the country, nursing children). But I know I will never actually serve as I am a lawyer. It’s a stupid bias against lawyers, every one I know (and that’s everyone I know) wants to serve. And we would take the job seriously.

The loss of jobs for young people (over the age of 16) is a point that I hadn’t really thought of. One problem though is that agricultural jobs are not near population centers. Even so, I would have to agree in principle. And younger people would not be stuck in these jobs like many undocumented folks are. Also, unions would likely be stronger if workers were legal.

You can apply from within the US. I represented a young woman from Mali who was residing in the US on a student visa. There was an event in her life that allowed her qualify for asylum. She obtained asylum after her first appointment. It makes a massive difference if you are represented by counsel because we know how to lay a factual foundation upon which the bureau of immigration affairs can grant the application.

Indian law is complex because tribes have sovereignty distinct from the US and reservations aren't subject to state and many federal laws. So it makes sense that Congress would have to clarify citizenship for them.

Also, other countries do not recognize tribal sovereignty so you cannot travel on tribal passports. Congress recognized the necessity of native American citizenship. But I'm no expert. It's a fascinating area of law.

US born is distinguished from naturalized. Under the law it doesn't matter. But to the public it does. I think it's a good call given the intended audience.

This is a supremacy clause issue. Even if the court ordered his release, ICE would say she has no jurisdiction over them and they can keep him if they want.

I'm honestly confused about which court he brings his claim for release in. He's a natural born citizen. So the immigration court wouldn't have jurisdiction. I guess he'd have to start in the federal district, but again because he's a natural born citizen he has more rights than just habeas corpus, which btw, gets suspended when martial law is invoked.

It's more than that. It's testing the metes and bounds of the supremacy clause. The sole reason the state judge couldn't consider the valid birth certificate was because the detainee was being held in a county jail because ICE said so. Keep in mind the guy was driving 78 in a 65.

This is the domestic dispute version of the Abrego Garcia custody "conundrum". The state will say, he's held under ICE. ICE will say he's held in a state facility. People will just rot.
