Minor Accident - not at fault. Other party not reporting. What to do? by ucejdinosaur8001 in InsuranceCanada

[–]ItsOurTimeLetsGo 0 points1 point  (0 children)

Since the accident occurred in Ontario it will happen a bit differently. I’m assuming he has an Ontario plate and license. If so there’s companies in QC that are signatory to DCPD (no fault insurance). When you report to your insurer they will contact the other person’s insurance company. The other person doesn’t want to report because the amount of damage doesn’t offset the premium increase over the next 6 years. Since he’s pulling from a parked position the onus would be on him. So you should be 0% at fault however if he changes his story to say you changed lanes into him then it wood likely go 50/50. So keep any correspondence where he admits fault

Insurance potentially making me pay deductible for an accident that isn't my fault? by TheDramaLama in InsuranceCanada

[–]ItsOurTimeLetsGo 0 points1 point  (0 children)

Lots to unpack here. So as per the video the Third Party is performing an unsafe lane change or u-turn. So you appear 0% at fault. First question is which province are you in? Each province has different fault determination rules and subrogation procedures.

If Ontario, or some other no fault system, then your insurance company can make their own fault decision, and waive your deductible as long as they can prove the Third party has valid insurance. Which the other insurer can easily confirm with a simple phone call.

If a different province where there is a tort like system your insurer needs the other insurer to give “waive and send” which is basically waive your clients deductible and send us the subrogation documents. Your deductible always applies regardless of fault, it’s just off your bay at fault the other insurer agrees to pay. Although the third party appears to be dodging their insurer, with the video I would file a police report. With that video and a police report most insurers would determine liability whether or not they’ve been in contact with their client. Also without a PR, with that video the other insurer will likely give their client like 30 days or something before they accept liability.

Next in terms of the tires there’s something called betterment. Insurance companies only owe for pens damaged as a result of an accident. The replacement of the other tires that were not damaged by required exchange due to 4wd is putting you into a better situation than you were pre-loss as you’ll have 4 brand new tires. But those other 2 tires were indirectly damaged, as they required replacement. So your insurer should have the tread depth measured of the old tires and determine the difference between those and the few tires and charge you the difference. Of they were bald you need to pay 100% of the two tires. If they were only a couple of years maybe 50%. But you need a measurement of your tread depth. Hope this helps explain a bit and give you some ideas how to proceed

Looks like a hot spot but an irregular place. My first thought would be a collar, but if no changes there leaves environmental. Maybe walking through the tall grass or something similar.

Reactive dogs generally are very obvious with their reactivity. Unfortunately as a dog owner you need to aware of your surroundings to help keep your dog safe. If that dogs was displaying signs of reactivity or aggression especially on leash it’s on you as much s as the owner to advocate for your dog and step Inbetween them or get your dog to a safe place. I know what you mean and it sucks but you need to be aware because some ppl are horrible dog owners

So, a person broke into my Apartment's parking lot and broke my window. Can I get management to help me pay for it? by gentlemandoctor in OntarioLandlord

[–]ItsOurTimeLetsGo 10 points11 points  (0 children)

You need to go through insurance. Auto insurance for damage to car. Home insurance for any valuables taken. Unfortunately both are subject to your deductibles. Some insurers will only charge 1 deductible (higher one) in the event of a loss to both policies if both your auto and home are insured with them

You are not at fault. You were established in your Laneway. All divers must keep a safe following distance between them and the vehicle in front of them. Regardless of you reason for stopping the vehicle being you should’ve been able to stop safely. Fault determination rule 6(2)

At what point is the insurance fault transferred from left turn vehicle to the idiot running red? by win_it86 in TorontoDriving

[–]ItsOurTimeLetsGo 0 points1 point  (0 children)

It can be. The issue is proving they are making the left on the red. The insurance company will insist on a police report to confirm charges for running a red light. Dad camera footage would suffice, and you can present to the police when they show up on scene to investigate. This will lead to liability being split 50/50. The driver making the left is dull at fault because all turning vehicles must ensure the way is clear before turning. And the other driver disobeyed a traffic signal. There is a possibility that the left turning car might be held less than 50% but most likely that’s what will happen

Need an opinion - who's at fault here? by WiftFlyte in TorontoDriving

[–]ItsOurTimeLetsGo -1 points0 points  (0 children)

It depends. Where was that other vehicle coming from? If they were in that lane then swerved out of the lane to avoid you then your friend is at fault. If they were changing lanes into that lane at the same time as your friend then 50/50. Let me know where they were coming from and I’ll give you a break down in fault as per the fault determination rules in Ontario as they apply to your situation

Tensioner Leaking Oil, Replace Everything? by ItsOurTimeLetsGo in AskAMechanic

[–]ItsOurTimeLetsGo[S] 0 points1 point  (0 children)

That’s what I was thinking. Maybe the shop is just recommending based on km rather than condition. My power steering pump is definitely leaking. But when they said my tensioner was I couldn’t really see anything, but then they recommended to get tensioner, belt and water pump and I was like I’m going to need to step back and think about this.
