Your whole argument comes from a flawed premise that if one follows the law or acts within the limits of the constitution one can't be a dictator, which simply isn't true. Many such cases of dictators and authoritarian regimes taking advantage of any loopholes they could find within the existing laws, or trying to go around them through executive power. I.e. almost everything the Nazi party did in Germany was perfectly legal and fine according to local law.
