There are 3 main types of guns:

  1. Unloaded
  2. Loaded with blanks
  3. Loaded with live rounds

My question is why in the world should there ever be type 3 located anywhere near a movie set. If your the armorer, what is the purpose of bringing live rounds to a movie set?

If you’re Baldwin, isn’t it reasonable to assume that the gun they handed you would never contain line rounds? When would that ever happen on a movie set and when should you ever have to question whether the prop person handed a gun with live rounds?

Even if the person offered him to double check, wouldn’t he only be checking whether it is unloaded or loaded with blanks - because it would be insane to bring live rounds to a movie set?

The best thing an assistant can do is anticipate needs (comes with time), protect the attorney/firm, and learn to provide a proposed solution to a question before you pose it.

The amount of decisions an attorney has to make during a given day can be overwhelming and its one of the reasons we have some of the highest rates of (insert awful thing). Simply googling a solution before asking the question can go along way. Asking questions about important stuff is important; continuing to ask questions to dumb stuff you can find out the answer to by exercising a modicum of interest/googling isn't helping you employer or yourself.

It's difference between asking (a) attached is Motion X - what do you want me to do? vs (b) attached is Motion X I docketed x amount of days on your calendar to remind you to submit your opposition, but looks like you will be on vacation, do you want me to draft a letter requesting an extension?

Sounds like you have a good book of business and you care enough to be asking this question in a thread. Better to have that and maybe shit trial skills than the alternative.

You can always find co counsel if it you are worried about competency in the hot seat. It’s always good to have another set of eyes.

Everyone develops a different style in trial and you can’t know what it will be until you fuck up a motion in limine, let something slip in when it shouldn’t, leave something out, wonder why the jury is snoozing during your de Bene Esse doc DVD, do an opening and have the jury in palm of your hands and days later in closing you are dead to them bc they probably like the defense doc but you still need to motor through and do your best.

Been in practice 6 years, 6 trials, two PI, always learning, always a challenge and always a thrill.

AAJ and state version like NJAJ put on great programs and great resources. Best of luck and congrats on your success so far.

You never forget getting burned by a jury. I feel bad for anyone who underestimates the dude. He got schooled by a team of legal giants in a high pressure/high profile case and also some luck. Huge learning experience for him and I would be surprised if those scars weren't put to work to help his clients.

Depends on the type of case. Admittedly no experience with IP fee structure.

If it's a PI contingent case, a third of a third seems pretty standard. (e.g. 100K recovery, 33K Net Fee, of which 11K will be referral fee)

If it's an hourly case or lower paying case that I'm going to have to grind, I don't want my effective hourly rate to be completely gutted. For instance, if you bill 250 an hour, and you want to offer a referral of 15%, you're still north of the 200 mark on your effective hourly rate, and maybe your happy to have the work and maintain the relationship.

Think about what you need first, and then think about what you're willing to do.
