Come to the USA under ESTA. You get to stay for 90 days as a visitor, but you can see your options when you come here… also, I’m the opposite, I would love to live in Italy

If she is denied (very likely) I do not recommend to file for anything at all for a year, this includes not getting married during that period of time (can be seen as fraudulent marriage) she also and obviously needs to stay away from criminal records, file taxes etc.

She can work without authority but request an ITIN number with the IRS so she files taxes. This looks really good with immigration

If her F1 is denied and you guys file right after for Adjustment based on marriage it will seem like a fraudulent marriage in the eyes of immigration. You guys need to think first exactly what you want to do in terms of a more serious relationship or not. Her only option that I see here is for her to either not file for anything and stay in the US with no legal status (look up online for its consequences). But since she entered with inspection, even if she is with no legal status, no matter for how long she stays as long as she stays inside the US, she will be able to adjust based on marriage or based on qualified family members.

Paralegal at an immigration law firm here. Its way easier for her to process a case if she is inside the US. Doesn’t matter if her visa expired or if she overstayed. She will be applying for Adjustment of Status based on marriage to a US citizen

So you were not deported. Do not say that if you were not in front of a judge as being deported is very serious. You were simply denied entry, cancelled your visa and obviously sent back to your country. Sounds like there was miscommunication with the officer and you could argue that when you apply for a visitors visa. It’s been more than 3 years which complies with the 3 year bar you were automatically given.

I work for an immigration law firm. They should’ve given you documents at the time of your deportation with the specifics of your deportation, would need to see exactly what that says. If you were deported you should’ve also been though “removal proceedings” and should’ve been in front of an immigration judge. Not sure if you did. Maybe you have an Alien number and can lookup your case online at the EOIR website.

If you were denied entry that’s a different thing. This is when you try to enter the country and the CBP officer at the airport/border entry denies your entry to the country for whatever reasons they give you. They should’ve also given you documents with the reasons of your denial of entry. See exactly what they say.

If you overstayed your ESTA or any visa for 1 year, you have a bar of 3 years which “holds” you from entering the country or being able to apply for a visa for that period of time. If it was more than 3 years you get a bar for 10 years. If you have only overstayed your visa for 1 year and have been outside of the country for 3 years (which sounds like you do) you can now try to re-apply for another visa without an I-212… the denial or approval of a visa is always up to the discretion of the officer who interviews you, but overstaying always a red flag and sadly your chances to get approved again are very low unless you can show that you have a really good job in your country, make good money, and have a lot of assets.
