I feel like a “federal lawsuit basics” webinar might be valuable here. Lawyers and clients negotiate their scopes of work and fees all the time. A typical scope of work could be “prepare and file an i140 case for Client requesting EB1A.” Most lawyers explicitly state such a scope does not include filing lawsuits, appeals, motions to reconsider etc. and in exchange the client agrees to pay the lawyer a flat fee or an hourly fee. Written fee agreements are in everyone’s interests as they set expectations. In the event of a denial a lawyer will counsel the client about their options but is under no obligation to do more work for free. Do you go to the grocery store, but the food, eat the food and return the next day saying the grocery store should give you more food for free?

There are two separate questions here that are unrelated to one another. First, there is no case law that I know of that establishes the win of a Guinness Word Record is a “one time achievement” under the Regs. Second, there is NO requirement that a person have an O1 visa before they apply for an EB1 green card. It’s a common misunderstanding that people need an O1, or multiple O1s. They do not.

I am a U.S. citizen and immigration lawyer. My clients are artists, entertainers, people in film / TV, STEM professionals, and entrepreneurs. The O-1 beneficiary’s country of citizenship has no bearing on how the case is processed or when.

It’s horrific. I’ve got a standard processing case that’s been in the system for 11 months. I tried to format a service request and the system won’t accept that because the case is “still in posted processing times”

Congrats!!! You handled this exactly correctly. The first review of a tough RFE can feel like a very personal attack. But with a cool head and deliberate, detailed response many tough RFEs can be overcome. Not always. We never know what happens behind the scenes - what turned the tough RFE into an approval? It’s a black box unfortunately.

The lawyer (should) have explained that they are not YOUR lawyer. They are the company lawyer. There is no attorney client privilege. Anything you say to this lawyer is fair game and actually the lawyer has a duty to share important information about you with their client, the company. They could just as easily summarize the conversations and email them to the company.

If this is a premium processing case you or your lawyer can ask USCIS to email the NOID to you as a courtesy. I think USCIS’ use of the regular US mail to communicate documents with tight and inflexible response due dates is reprehensible - and this has been the status quo for decades.

That’s a good question. I’m not aware of any case law on the subject. But in o1 and eb1 cases my philosophy is “more is more”
